Title 2 Provisions applicable to petty offences

มาตรา๑๐๒ความผิดลหุโทษ คือ ความผิดซึ่งต้องระวางโทษจำคุกไม่เกินหนึ่งเดือน หรือปรับไม่เกินหนึ่งพันบาท หรือทั้งจำทั้งปรับเช่นว่ามานี้ด้วยกัน

Section102.A petty offence is an offence which incurs a penalty of imprisonment not over one month, or fine not over one thousand baht, both of the imprisonment and fine so described.

มาตรา๑๐๓บทบัญญัติในลักษณะ ๑ ให้ใช้ในกรณีแห่งความผิดลหุโทษด้วย เว้นแต่ที่บัญญัติไว้ในสามมาตราต่อไปนี้

Section103.The provisions of Title 1 shall also apply to cases of petty offences, save those provided in the following three sections.

มาตรา๑๐๔การกระทำความผิดลหุโทษตามประมวลกฎหมายนี้ แม้กระทำโดยไม่มีเจตนา ก็เป็นความผิด เว้นแต่ตามบทบัญญัติความผิดนั้นจะมีความบัญญัติให้เห็นเป็นอย่างอื่น

Section104.The commission of a petty offence under this Code, even unintentional, renders [the offender] guilty [thereof], save where the provision [governing] such offence obviously provides otherwise.[1]

มาตรา๑๐๕ผู้ใดพยายามกระทำความผิดลหุโทษ ผู้นั้นไม่ต้องรับโทษ

Section105.[When] anyone attempts to commit a petty offence, that one is not required to undergo the penalty [therefor].

มาตรา๑๐๖ผู้สนับสนุนในความผิดลหุโทษไม่ต้องรับโทษ

Section106.An aider in [the commission of] a petty offence is not required to undergo the penalty [therefor].

Notes

1. The Thai text literally translates “The commission of a petty offence under this Code, even committed without intent, is the guilt, except, however, according to the provision [governing] such offence, there would be a text providing [something] to be seen in a different way”. The English draft of the Penal Code (Office of the Juridical Council, n.d., p. 16/53) says “Except when otherwise provided by law, petty offences are punishable, notwithstanding the fact that they are not committed intentionally”.
