| มาตรา๒๗๐ผู้ใดใช้หรือมีไว้เพื่อใช้ซึ่งเครื่องชั่ง เครื่องตวง หรือเครื่องวัดที่ผิดอัตรา เพื่อเอาเปรียบในการค้า หรือมีเครื่องเช่นว่านั้นไว้เพื่อขาย ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกพันบาท หรือทั้งจำทั้งปรับ | Section270.Anyone who uses or possesses for use an irregular[1] device for chang, device for tuang, or device for wat[2] so as to gain advantage in trade, or possesses such a device for sale, incurs a penalty of imprisonment not over three years, or fine not over six thousand baht, or both such imprisonment and fine. |
| มาตรา๒๗๑ผู้ใดขายของโดยหลอกลวงด้วยประการใด ๆ ให้ผู้ซื้อหลงเชื่อในแหล่งกำเนิด สภาพ คุณภาพ หรือปริมาณแห่งของนั้นอันเป็นเท็จ ถ้าการกระทำนั้นไม่เป็นความผิดฐานฉ้อโกง ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองพันบาท หรือทั้งจำทั้งปรับ | Section271.Anyone who sells goods by, in whatever manner, deceiving a buyer into erroneously believing in the false origin, condition, quality, or quantity of those goods, incurs a penalty of imprisonment not over one years, or fine not over six thousand baht, or both such imprisonment and fine, if such act does not constitute an offence of fraud. |

| มาตรา๒๗๒ผู้ใด | Section272.Anyone who— |
| (๑)เอาชื่อ รูป รอยประดิษฐ์ หรือข้อความใด ๆ ในการประกอบการค้าของผู้อื่นมาใช้ หรือทำให้ปรากฏที่สินค้า หีบ ห่อ วัตถุที่ใช้หุ้มห่อ แจ้งความ รายการแสดงราคา จดหมายเกี่ยวกับการค้า หรือสิ่งอื่นทำนองเดียวกัน เพื่อให้ประชาชนหลงเชื่อว่า เป็นสินค้าหรือการค้าของผู้อื่นนั้น | (1)puts to use or causes to appear on merchandise, boxes, wrappers, casings, notifications, price lists, trade-related letters, or other similar things any name, image, artificial mark, or information in [relation to] the conduct of trade of another [person], so as to cause people to erroneously believe that the merchandise or trade [in question] belongs to the latter;[4] |
| (๒)เลียนป้ายหรือสิ่งอื่นทำนองเดียวกัน จนประชาชนน่าจะหลงเชื่อว่า สถานที่การค้าของตนเป็นสถานที่การค้าของผู้อื่นที่ตั้งอยู่ใกล้เคียง | (2)imitates a label or other similar thing to the degree likely [to cause] people to erroneously believe that his[5] place of trade is another [person]’s place of trade located nearby; |
| (๓)ไขข่าวแพร่หลายซึ่งข้อความเท็จเพื่อให้เสียความเชื่อถือในสถานที่การค้า สินค้า อุตสาหกรรม หรือพาณิชย์การของผู้หนึ่งผู้ใด โดยมุ่งประโยชน์แก่การค้าของตน | (3)circulates false information so as to injure the credit of any particular person’s place of trade, merchandise, industry, or commerce, with a view to benefiting his[5] own trade; |

| มาตรา๒๗๓ผู้ใดปลอมเครื่องหมายการค้าของผู้อื่นซึ่งได้จดทะเบียนแล้ว ไม่ว่าจะได้จดทะเบียนภายในหรือนอกราชอาณาจักร ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกพันบาท หรือทั้งจำทั้งปรับ | Section273.Anyone who counterfeits a registered trademark of another [person], whether [it be] registered inside or outside the Kingdom, incurs a penalty of imprisonment not over three years, or fine not over six thousand baht, or both such imprisonment and fine. |
| มาตรา๒๗๔ผู้ใดเลียนเครื่องหมายการค้าของผู้อื่นซึ่งได้จดทะเบียนแล้ว ไม่ว่าจะได้จดทะเบียนภายในหรือนอกราชอาณาจักร เพื่อให้ประชาชนหลงเชื่อว่า เป็นเครื่องหมายการค้าของผู้อื่นนั้น ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองพันบาท หรือทั้งจำทั้งปรับ | Section274.Anyone who imitates a registered trademark of another [person], whether [it be] registered inside or outside the Kingdom, so as to cause people to erroneously believe that [the imitated trademark] is a trademark of the latter,[4] incurs a penalty of imprisonment not over one year, or fine not over two thousand baht, or both such imprisonment and fine. |
| มาตรา๒๗๕ผู้ใดนำเข้าในราชอาณาจักร จำหน่าย หรือเสนอจำหน่าย ซึ่งสินค้าอันเป็นสินค้าที่มีชื่อ รูป รอยประดิษฐ์ หรือข้อความใด ๆ ดังบัญญัติไว้ในมาตรา ๒๗๒ (๑) หรือสินค้าอันเป็นสินค้าที่มีเครื่องหมายการค้าปลอมหรือเลียนเครื่องหมายการค้าของผู้อื่นตามความในมาตรา ๒๗๓ หรือมาตรา ๒๗๔ ต้องระวางโทษดังที่บัญญัติไว้ในมาตรานั้น ๆ | Section275.Anyone who brings into the Kingdom, disposes of, or offers for disposal merchandise which bears[6] any name, image, artificial mark, or information as provided in section 272(1), or merchandise which bears[6] a counterfeit trademark or imitates a trademark of another [person] according to section 273 or section 274, incurs the penalty as provided in such and such section. |

[edit]- ↑ Phit attra (Thai: ผิดอัตรา) literally translates “wrong [from] attra”. Samnak-ngan Ratchabandittayasapha (2013) defines attra as (1) rate, amount; (2) regular, usual. Phit attra is therefore translated as “irregular” here. In the English draft of the Penal Code (Office of the Juridical Council, 1950, p. 29/70), the phrase “differs from the standard of weighing or measuring” was used.
- ↑ Samnak-ngan Ratchabandittayasapha (2013) defines chang, tuang, and wat as follows:
- Chang (Thai: ชั่ง) means “to ascertain the weight”.
- Tuang (Thai: ตวง) means “to take up with any container in order to ascertain the amount or quantity”.
- Wat (Thai: วัด) means “to check the extent or quantity of anything, such as to wat the length, width, height, or knowledge”.
