2545 BE
Bhumibol Adulyadej R
Given on the 13th day of January 2545 BE
Being the 57th year of the present reign
Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:
Whereas it is appropriate to dissolve the Post and Telegraph Department, Ministry of Communications;
Therefore, by virtue of the powers under section 221 and section 230, paragraph 2, of the Constitution of the Kingdom of Thailand, as well as section 8quater, paragraph 1, of the Act on Rules for Public Administration of the State, 2534 BE, as amended by the Act on Rules for Public Administration of the State (No. 4), 2543 BE, He orders with His gracious pleasure that the following Royal Decree be enacted:
Section1.This Royal Decree is called the "Royal Decree Dissolving the Post and Telegraph Department, Ministry of Communications, 2545 BE".
Section2.This Royal Decree shall come into force from the day following the day of its publication in the Royal Gazette onwards.
Section3.The Post and Telegraph Department, Ministry of Communications, shall be dissolved, and the stipulations of (7) of section 16 of the Act Reorganising Ministries, Subministries, and Departments, 2535 BE, shall be repealed in accordance with section 230, paragraph 5, of the Constitution of the Kingdom of Thailand. However, [this shall be effective] from the day of expiry of a limit of thirty days reckoned from the day [the Monarch][1] appoints the President and Members of the National Telecommunications Commission according to the Act on the Body for Allocation of Frequency and Regulation of Radio and Television Broadcasting Businesses and Telecommunication Businesses, 2543 BE.
Section4.Activities relating to the businesses, property, rights, powers and duties, debts, and budgets, as well as public servants and employees, of the Post and Telegraph Department, Ministry of Communications, shall be conducted in accordance with the provisions of the Act on the Body for Allocation of Frequency and Regulation of Radio and Television Broadcasting Businesses and Telecommunication Businesses, 2543 BE, in respect of which section 8quater, paragraph 2, paragraph 3, and paragraph 3, of the Act on Rules for Public Administration of the State, 2534 BE, as amended by the Act on Rules for Public Administration of the State (No. 4), 2543 BE, shall not apply.
Section5.The Minister of Communications shall be in charge of the execution of this Royal Decree.
Police Lieutenant Colonel Thaksin Shinawatra
Prime Minister
Note: The grounds for promulgation of this Royal Decree are as follows: Whereas the Act on the Body for Allocation of Frequency and Regulation of Radio and Television Broadcasting Businesses and Telecommunication Businesses, 2543 BE, provides that all the businesses, property, rights, powers and duties, debts, and budgets of the Post and Telegraph Department, Ministry of Communications, are to be transferred to the Office of the National Commission for Telecommunication Businesses, save the postal business and the budget money under the Chapter on Monthly Salaries and Regular Wages being in possession of [any] persons, which shall be transferred to the Office of the Permanent Secretary, Ministry of Communications, the operation of the said provision results in cessation of the businesses as well as the powers and duties of the Post and Telegraph Department, Ministry of Communications, making it appropriate to dissolve the Post and Telegraph Department, Ministry of Communications. However, section 230, paragraph 2, of the Constitution of the Kingdom of Thailand, as well as section 8quater, paragraph 1, of the Act on Rules for Public Administration of the State, 2534 BE, as amended by the Act on Rules for Public Administration of the State (No. 4), 2543 BE, provide that dissolution of a public entity is effected by the enactment of a Royal Decree. It is therefore necessary to enact this Royal Decree.
