Works in this category are in the public domain in Argentina because they were created in Argentina and the term of copyright has expired. According to Law No. 11.723 as amended up to Law No. 26.570 of November 25, 2009, the following works are public domain:

• sound recordings published more than 70 years ago (before January 1, 1954),
• photographs published more than 20 years ago (before 2004) and created more than 25 years ago (before 1999),
• cinematographic works whose author, producer, director and composer died over 50 years ago (before 1974),
• other anonymous works published over 50 years ago (before January 1, 1974), and
• other works whose author died over 70 years ago (before January 1, 1954).

Works in this category are also in the public domain in the United States because they were first published outside the United States (and not published in the U.S. within 30 days), and they were first published before 1989 without complying with U.S. copyright formalities (renewal and/or copyright notice) and they were in the public domain in Argentina on the URAA date (January 1, 1996). This is the combined effect of Argentina having joined the Berne Convention in 1967, and of 17 USC 104A with its critical date of January 1, 1996.

Because the Argentine p.m.a. term in 1996 was 50 years, the critical date for copyright in the United States under the URAA is January 1, 1946.

These works may be in the public domain in countries and areas with longer native copyright terms that apply the rule of the shorter term to foreign works.
