Executive Order 126

Rule X, section 5, is hereby amended by striking out after the word "entered," in the third line thereof, the language "a position appointment to which is made by the President by and with the advice and consent of the Senate," and substituting therefor the following: "an unclassified position in any part of the executive civil service other than a position of mere laborer or workman, or to serve under the authority of the General Government as a civilian in the insular possessions under the control of the United States."


The section as amended shall read as follows:

  1. Transfer shall not be made from a position not classified under the civil-service act to a classified position: Provided, That a person who, by promotion or transfer from a classified position, has entered an unclassified position in any part of the executive civil service other than a position of mere laborer or workman, or to serve under the authority of the General Government as a civilian in the insular possessions under the control of the United States, and has served continuously therein from the date of said promotion or transfer, may be transferred from said unclassified position to the position from which he was so transferred, or to any position to which transfer could be made therefrom.
