Mr. Justice Pitney, with whom concurred Mr. Justice Day, Mr. Justice Van Devanter, and Mr. Justice Lamar, dissenting: In No. 446,-the appeal of Farish, the depositor,-for reasons expressed in the dissenting opinion in Lankford v. Platte Iron Works Co. this day decided, 235 U.S. 461, 59 L. ed. --, 35 Sup. Ct. Rep. 173, it seems to me that the decree here under review should be reversed.
In No. 447,-the cross-appeal,-I concur in the result reached by the court.
