What about EU and EU copyright ? --Jklamo (talk) 19:50, 6 February 2016 (UTC)Reply

New Zealand

[edit]

As per the New Zealand Intellectual Property Office:

Crown copyright protects work created or owned by the New Zealand government for 100 years from the end of the calendar year in which the work was made.

Additionally:

Crown copyright protected material does not extend to any intellectual property owned by third parties (eg a photograph or trade mark). You must get authorisation from the third party to reproduce these items.

No copyright is applied to:

  • New Zealand legislation (Bills, Acts, regulations and bylaws)
  • Parliamentary debates
  • Select Committee reports
  • Court and tribunal judgements
  • Royal commission, commission of inquiry, ministerial and statutory inquiry reports.

Poland

[edit]

Hi, this is my proposal of creating a respective template for official texts in Poland (an equivalent to {{PD-Polishsymbol}} on Wiki Commons), as I've just came accross a copyright licence absence notice on Constitution of the Republic of Poland.

Template proposals

[edit]

A

[edit]

This work is in the public domain according to Article 4 of the Act on Copyright and Related Rights of 4 February 1994 (Dz. U. z 2022 r. poz. 2509) "(case 1) normative acts or their official drafts" as well as "(case 2) official documents, materials, signs and symbols [...] are not subject to copyrights". Hence it is assumed that this work has been released into public domain.

[edit]

This work is in the public domain because, according to the Article 4 of the Act on Copyright and Related Rights of 4 February 1994 (Dz. U. z 2022 r. poz. 2509) following works "are not subject to copyright:

  1. normative acts or their official drafts;
  2. official documents, materials, signs and symbols;
  3. published patent or industrial design specifications;
  4. simple press releases".

Hence it is assumed that this work has been released into public domain.

Explanation

[edit]

Law

[edit]

Cited source is Ustawa z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych, first published Dz. U. 1994 Nr 24 poz. 83, and latest consolidated text Dz. U. z 2022 r. poz. 2509 after amendments, and ISAP site. The relevent article is Article 4:

Art. 4. Nie stanowią przedmiotu prawa autorskiego:

1) akty normatywne lub ich urzędowe projekty;
2) urzędowe dokumenty, materiały, znaki i symbole;
3) opublikowane opisy patentowe lub ochronne;
4) proste informacje prasowe.

Article 4. [The following] are not subject to copyrights:

1) normative acts or their official drafts;
2) official documents, materials, signs and symbols;
3) published patent or industrial design specifications/[informative] descriptions;
4) simple press releases.

Translation and wording

[edit]

The only translation with known authorship avalible online is (this), with free sample covering the Article 4 (here). Other translations include one by Polish Ministry of Culture and National Heritage (link) (presumably consolidated in 2006, text not up to date), one by Global-Regulation (link) (mashine translation, unknown exact consolidation date (after 2015)), and Wikisource at Polish Copyright Law with no cited source nor text consolitation date. Therefore the chosen wording of the Article 4 may be debatable.

Referencing

[edit]

Please note that the linked publication in the tamplate shall be directly the Dziennik Ustaw, 'Jurnal of Laws' (dziennikustaw.gov.pl), which is the original place of publication of acts of parliament and only source of law. The commonly referenced ISAP run by the Chancellery of the Sejm is not a government gazette, but a legal web portal providing acts' texts with the VERY handy bibliographical descriptions. And btw contents published in ISAP fall under the copyright and are released by the Chacellery of Sejm for free use under source recognition licence:[1]

Zezwala się na wykorzystywanie (w tym kopiowanie) materiałów znajdujących się w bazie ISAP w sieci Internet, z zaznaczeniem źródła ich pochodzenia. Using (and copying) contents from the ISAP database in the Internet is allowed after indicating their original source.

Purpose

[edit]

I am aware that creating the template does not resolve the problem of licencing translations themeselves of Polish legal acts on Wikisources. However in the case of the Constitution, the source given for the translation is the Sejm website (Constitution) which applies same licencing policy as for the ISAP database. [2]
