Justice SCALIA, with whom THE CHIEF JUSTICE and Justice KENNEDY join, dissenting.

For the reasons stated in my opinion in Chisom v. Roemer, --- U.S. ----, 111 S.Ct. 2371, --- L.Ed.2d ----, I would not apply § 2 of the Voting Rights Act to vote dilution claims in judicial elections, and would therefore affirm the judgment below.
