Interments (felo de se) Act 1882
An Act to amend the law relating to the interment of any person found felo de se. [3rd July 1882.]
WHEREAS it is expedient that the laws and usages relating to the interment of the remains of persons against whom a finding of felo de se shall be had should be further altered and amended:
Be it therefore enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same as follows:
Repeal of 4 Geo. 4. c. 52.
1. The Act of the fourth year of George the Fourth, chapter fifty-two, intituled "An Act to alter and amend the law relating to the interment of the remains of any person found felo de se," shall be and the same is hereby repealed.
Coroner to give directions for interment.
2. From and after the passing of this Act it shall not be lawful for any coroner or other officer having authority to hold inquests to issue any warrant or other process directing the interment of the remains of persons against whom a finding of felo de se shall be had in any public highway, or with any stake being driven through the body of such person, but such coroner or other officer shall give directions for the interment of the remains of such person felo de se in the churchyard or other burial ground of the parish or place in which the remains of such person might by the laws or custom of England be interred if the verdict of felo de se had not been found against such person.
Interment.
3. The interment of any such person as aforesaid may be made in any of the ways prescribed or authorised by the Burial Laws Amendment Act, 1880.[1]
Rites of Christian burial not to be performed on interment.
4. Save as aforesaid, nothing herein contained shall authorise the performing of any of the rites of Christian burial on the interment of the remains of any such person as aforesaid, or be taken to alter the laws or usages relating to the burial of such persons.
Extent of Act.
5. This Act shall extend to the Channel Islands, but shall not apply to Scotland or Ireland.
Short title.
6. This Act may be cited as the Interments (felo de se) Act, 1882.
