Mr. Justice BLACK concurs in the result.

Mr. Justrice RUTLEDGE concurs in the result, and in the opinion insofar as it relates to the petitioner McDonald. With respect to the petitioner Washington he is of the view that the evidence, having been illegally obtained, was inadmissible. Cf. Malinski v. People of State of New York, 324 U.S. 401, opinion dissenting in part page 420, at pages 430-432, 65 S.Ct. 781, 790, at pages 795, 796, 89 L.Ed. 1029.
