that the Disputed Instruments should be deemed “third party bank checks.”

Accordingly, we adopt the Special Master’s recommendations in the First Interim Report, along with his initial proposed order, to the extent they are consistent with this opinion.[1] We also overrule Delaware’s exceptions to the First Interim Report and remand this matter to the Special Master for further proceedings consistent with this opinion.[2]

It is so ordered.


  1. Because we decline to adopt the Special Master’s Second Interim Report, we need not address the Defendant States’ argument that we should not entertain the Second Interim Report.
  2. In light of our conclusions in these cases, Pennsylvania’s alternative request that we reconsider the common-law escheatment rules is moot.
