LaiNd Tenure in Oregon. 133 this condition, that if the lessee shall fail, neglect or refuse to perform any part of the covenants herein contained on his part to be observed and performed, or if the above rent shall be in arrears and unpaid for the space of ten days after the same or any part thereof shall become due, upon the breach on nonperformance of any of the covenants herein contained on his part to be observed and performed, the lessor may imme- diately or at any time thereafter while such default or breach shall continue, and without further notice or demand, enter into and upon said premises or any part thereof in the name of the whole and repossess the same as of his former estate, and expel the said lessee or those claiming under him, forcibly, if necessary, without being taken or deemed guilty of trespass, in any manner and without prejudice to any remedies which might otherwise be used for arrears of rent or preceding breach of covenant. It is also agreed and understood upon by the party of the second part that this lease is not transferable to any one with- out the consent of the party of the first part.
