Item volumus & providemus, quod proclametur in fingulis Comitatibus quod omnes illi qui habent tallias de Scaccario de debitis fuis, vel anteceffo- rum fuorum, ibidem hactenus folutis, & nondum allocatis, que adhuc veniunt in fummonitione Scac- carii, liberentur hujufmodi tallie Vic' fuis allocande ad Scaccarium fuper compotis fuis, & Vic' pre- cliiSti faciant iilis a quibus tallias fie receperint fcrip- ta fua teflificantia receptionem talliarum illarum fummam & occafionem debitorum. , Interfint etiam receptioni talliarum illarum duo fideles Milites ad hoc deputandi, inter quos & pre- fatum Vic' riant cirograffa de hujufmodi receptioni- bus, figillis eorum alternatim munita. Prefati vero Milites ad hoc deputati mittant ad Scaccarium ad terminum ftatutum partes fuas ciro- grafforum predidtorum in forma predi&a, ut per vifum & teftimonium eorundem difte tallie per Vic' fie recepte exibeantur & fuper compotis fuis allo- centur. Proclametur etiam, quod nifi illi qui habent hu- jufmodi tallias exhibeant Vic' & Militibus ut pre- dictum eft exequendas, diftringantur pro toto de- bito, & quod tallie predi&e pro non folutis reputa- buntur. Item ut debita que adhuc veniunt ad fummoni- tionem Scaccarii unde debitores proferunt tallias contra diverfos Vic* deputentur & acquietentur. Providemus etiam, quod allqui ad hoc affignandi Cx parte noftra mittantur in fingulis Com' qui ha- beant potcftatem plenam inquirendi de hujufmodi debitis, & etiam vocandi coram eis folempniter tarn Vic' quam heredes & aflignatos & tenentes terra- rum eorum, fi ipfi mortui fuerint, qui hujufmodi debita receperint, & etiam procedendi ad hujuf- modi inquif. capiend. fi necefte fuerit cum partes contra quas predi&e tallie oftenfe fuerint venerint, cum non, teftificata prius per Vic' fummonitione eis rationabiliter inde fafta & inquifita & difcufTa in prefentia partium fi intereffe voluerint veritate, faciant inquifitores rotulos de omnibus coram eis convi&is & conceflis ; & irrotulatis predictis de- bitis, ftatim frangantur tallie eorundem. Prefati vero inquifitores mittant ad Scaccarium fub figillis fuis rotulos fuos prediftos, ut ibi fcrutin. inde fa- ciend. examinentur que debita funt in toto & que in parte foluta, & que non, et acquietentur debi- tores fecundumquod per curiam fuerit faciend. Ttem volumus & providemus, quod camerarii non faciant de cetero vie' feu eorum quibufcum- que ballivis, tallias dividend}, nifi receptis ab eis prius particulis, fummas & occafiones debitorum 4k nomina ea folventium continentibus-, in quas upon the Accompt of Sheriffs ; and the Debts where- of the Sheriffs are anfwerable fhall be written in the annual Roll, and there fhall be acquitted. ' III. Moreover, we will and provide, That it fhall be proclaimed in every County, that all they that have Tallies of the Exchequer, for the Debts of themfelves or their Anceftors, hitherto paid ufually there, and not yet allowed, which yet do come in the Summons of the Exchequer, they do deliver to the Sheriffs fuch Tallies, to be allowed at the Exche- quer upon their Accompts. (2) And the Sheriffs fhall make to them (of whom they fhall fo receive Tallies) their Writings, witneffing the Receipt of thofe Tallies, and Occafion of the Debts. i IV. Two faithful Knights deputed thereunto, fhall be prefent at the Receipt of the Tallies aforefaid, be- tween whom and the faid Sheriffs Indentures fhall be made of fuch Receipts, with the Seals of them both interchangeably. ' V. The forefaid Knights, deputed thereunto, fhall fend the Parts of their Indentures, at the Term ap- pointed, unto the Exchequer in Form aforefaid, to the end, that by the View and Witnefs of them, the faid Tallies fo received by the Sheriffs, may be (hew- ed and allowed upon their Accompts. ' VI. Moreover, it fhall be proclaimed, That ex- cept thofe that have fuch Tallies do deliver them to the Sheriffs and Knights, as afore is faid, that then they fhall be diftrained for the whole Debt, and that the forefaid Tallies (hall be reputed for unpaid. ' VII. Moreover, the Debts which yet are to come in the Summons of the Exchequer, whereof the Debtors do proffer Tallies againft divers Sheriffs, fhall be defalked and acquitted. ' VIII. Moreover we provide, That certain Perfons afligned thereunto on our Behalf, fhall be fent into every Shire, which fhall have full Power to enquire of fuch Manner of Debts ; (2) and alio to call afore them folemnly, as well the Sheriffs, as their Keirs and Affigns, and the Tenants of their Lands, in cafe they be dead that have received the Debts ; (3) and alfo, if Need be, to proceed to the taking of fuch manner of Inquefts, whether the Parties (againft whom the forefaid Tallies were fhewed) do come or not ; fo that the Sheriff do return a reafonable Sum- mons made to them therefore ; (4) and fo the Truth being inquired and difcuffed in Prefence of the Par- ties (if they will be there) the Inquifitors fhall make Rolls of them that fhall be convicT: afore them; fo that the forefaid Debts being confeffed and inrolled, the Tallies of the fame fhall be forthwith broken. (;) And the Sheriffs fhall have in their Cuftody the Tranfcripts of the fame Rolls, under the Seals of the Inquifitors ; (6) and fhall furceafe in making Diftrefies for the Debts contained in the fame, until they fhall have otherwife in Commandment from us therefore. (7) And the forefaid Inquifitors fhall fend unto the Exchequer the forefaid Rolls under their Seals, that it may be examined there, by a Search to be made therefore, what Debts be paid in the Whole, and what are paid in Part, and what Debts there be, whereof the Debtors be not acquitted, according as fhall be convenient to be done. 'IX. Moreover, we will and provide, That the Chamberlains from henceforth fhall not make to the Sheriffs, or any of their Bailiffs, Tallies of dlvlden- dis, unlefs they firft receive of them Writings con- taining the particular Sums * of the Mtions of Debts, L: * anal Tallies for Debts.
