(6) And when he cometh to the Court, Audi- tors fhall be affigned to take his Accompt, before whom if he be found in Arrearages, and cannot pay the Arrearages forthwith, he fhall be committed to the Gaol to be kept in Manner aforefaid. (7) And if he flee, and it be returned to the Sheriff that he cannot be found, Exigents fhall go againft him from County to County, until he be outlawed, and fuch Prifoner fhall not be replevifable. (8) And let the Sheriff or Keeper of fuch Gaol take Heed, if it be within a Franchife, or without, that he do not fuffer him to go out of Prifon by the common Writ called Rephgiare, or by other Means, without Aflent c; his Mafter; (9) and if he do, and thereof be con- vict, he fhall be anfwerable to his Mafter of the Damages done to him by fuch his Servant, according as it may be found by the Country, and fhall have his Recovery by Writ of Debt. (10) And if the Keeper of the Gaol have not wherewith he may be juftified, or not able to pay, his Superior that com- mitted the Cuftody of the Gaol unto him, fhall be anfwerable by the fame Writ.' FOrafmuch as many, through Malice intending to grieve other, do procure falfe Appeals to be made of Homicides and other Felonies by Appel- lors, having nothing to fatisfy the King for their falfe Appeal, nor to the Parties appealed for their Damages;" (z) ' it is ordained, That when any, being appealed of Felony furmifed upon him, doth acquit himfelf in the King's Court in due Manner, either at the Suit of the Appellor, or of our Lord the King, the Juftices, before whom the Appeal fhall be heard and determined, fhall punifh the Appellor by a Year's Imprifonment, and the Appellors fhall never- thelefs reftore to the Parties appealed their Damages, according to the Difcretion of the Juftices, having Refpect to the Imprifonment or Arreftment that the Party appealed hath fuftained by reafon of fuch Ap- peals, and to the Infamy that they have incurred by the Imprifonment or otherwife, and fhall neverthe- less make a grievous Fine unto the King. (3) And if peradventure fuch Appellor be not able to recom- penfe the Damages, it fhall be inquired by whofe Abetment or Malice the Appeal was commenced, if the Party appealed defire it ; (4) and if it be found by the fame inqueft, that any Man is Abettor through Malice, at the Suit of the Party appealed, he fhall be diftrained by a judicial Writ to come before the Juftices; (5) and' if he be lawfully convict of fuch malicious Abetment, he fhall be punifhed by Im- prifonment and Reftitution of Damages, as before is faid of the Appellor.
