ILLIAM BUTLER, which is within Age, and in Ward of our Lord the King, hath fhewed unto his Highnefs, that where " Gawin Butler his Brother (whole Heir he is) had " impleaded one Walter de Hapeton by the King's " Writ, for Wafte and Deftrudtion made by him the " faid Walter in certain his Lands and Tenements, " which the fame Walter held for Term of his Life, " of the Inheritance of the forefaid Gawin in Wimme " and Thirke; and the forefaid Gawin, before he had " obtained Judgement, died, after whofe Death the " forefaid JVilliam by like Writ impleaded the forefaid " Walter for the Wafte and Deftru&ion made by him " of long Time. The fame Walter, before Gilbert " Thornton and his Companions afRgned to hear the " King's Pleas, came in, and faid, that he ought not to " anfwer to the fame JVilliam for the Wafte and De- " ftruiflion made in the Time of another, before the " Right of the faid Inheritance defcended unto him, " and thereupon demanded Judgement. (2) And for-
- ' afmuch as certain juftices did not agree in giving of
" the faid Judgement, becaufe it feemed to fome that " it fbould not be agreeable to the Law, that any Per- " fon fhould obtain Advantage and Recompence by the •" forefaid Writ, which is a Writ of Trefpafs done to " a Perfon certain, but only the feme Perfon to whom " and in whofe Time the Trefpafs was done; (3) " other Juftices, with the more Part of the King^s " Council, were in the contrary Opinion, alledging

- Writ of Wafte in the forefaid Cafe, and alfo in other
' where the fame Writ ought to hold Place ; (z) and ' Jt fhall hold Place as well for Wafte and Deftru£tion ■' made in Lands and Tenements of his own Inheri-
- tance, and as well in the Times of his Anceftors, as
' at any other Time that the Fee and Inheritance de-
- fcended unto him, and fhall be anfv/ered unto there-
- fore; (3) and that he fhall recover the Tenements
- waftid, and Damages, as it is ordained in the Second
, ' Statute of Wejlmhifter, of Damages to be recovered ' ' in a Writ of Wafte, if the Tenant be convift of ' Wafte.
