- Quit- claim, or other fpecial Deed, made within a
- Franchife within the Bounds of the Realm, where
the King's Writ runneth not;" ' (2) it is enacted'igH. 6. f. iu and eftabliflied, That when fuch Deeds be ftiewed forth in Bar of an Action, bearing Date in a Place within the fame Franchife, although there be Wit- neffes of the fame Franchife named in the fame Deeds, if the fame Deeds be denied, Procefs fhall be awarded into the fame County where the Plea fhall be moved, to have the Inqueft of the Country and the Witneffes to appear; (3) and if the Witneffes- come not at the great Diftrefs returned, then for the Abfence of the faid Witneffes, the Juftices fhall not let to proceed to the taking of the Inqueft, as well as if fuch Deed did bear Date in the fame Shire where the Plea was moved, and the Witneffes were of the- fame County.' ITEM, At the Requeft of the Commons, our Lord the King by the faid Affent hath ordained and eftabiifhed, That Juftices of Aflifes, Gaol-de- livery, and of Oyer and Terminer, fhall fend all their Records and Proceffes determined and put in Execu- tion, to the Exchequer at Michaelmas, every Year once to be delivered there ; (2) and the Treafurer and Chamberlains, which for the Time fhall be, having the Sight of the Commiflions of fuch Juftices, fhall receive the fame Records and Proceffes of the faid Juftices under their Seals, and keep them in the Treafury, as the Manner is ; (3) fo that the Juftices always do firft take out the Eftreats of the faid Re- cords and Proceffes againft them, to fend to the Ex- chequer, as they were wont before.'
