ITEM ordeignez eft & eftabliz qe les fercheours en chefcun port dEngleterre foient chargiez & jurrcz qils ne leffent a ferme leur office de fercherie ne les occupient par deputee et qils ne preignent defore enavaunt de nulles meftres des niels de lour office de fercherie faire nul argent ne monoie pur leur bienvenuz & bienalees ne nul autre chofe pur yce.31 come il ad efte pris & levez devant ces heures autrement qe ne ferra ordeignez a eux pur lour office par noftre Seignur le Roy. Et qe nul fercheour foit hoft a nul marchant ne maryner. Et en cas qafcun fercheour fac: le contrair de ceft eftatut & ce duement provee foit mefme le fercheour oufte de fon office pur toutz jours & face fyn & ranceon a la volentee du Roy. This Chapter follow: XT EM it is ordained and eftablifhed, That the Searchers in every Port of England ihn be charged and fworn, That they fhall not let to !erm their Offices of fearching, nor occupy the fame by a De- puty ; (2) and that from henceforth they take of no Matters of Ships for their Office of fearching, any- Silver or Monty for their Welcome and Farjwel, nor any other Thing for the fame, as it hath been taken and received before this Time, otherwife than (hall be ordained to them for their Office by our Lord the King; (3) and that no Searcher be Hoft to an Mer- chant or Mariner. (4) And in cafe that any Sear- cher do contrary to this Statute, and that duly proved, the fame Searcher fhall be put out of his Office for ever, and make Fine and Ranfom at the King's Will.' Cap. Grandfather to our Lord the King, that if the King make Collation or Prefentment to any Benefice in another's Right, that the Title whereupon he groundeth him lhould be well examined that it be true; (2) and at what Time, before Judgement given, the TLle be found by good Information un- true and unjuft, the Collation or Prefentment thereof made, fhall be repealed and adnulled. (3) And moreover, in a Statute made after in the Time of King Richard, it was ordained and eftabiiihed, That if the King prefent to any Benefice that is full 13 R. 2. flat. r. of any Incumbent, that the King's Prefentee fhall c - '• not be received by the Ordinary, till the King hath 1 oi ' 2?9 ' recovered his Prefentment by Procefs of the Law in
- his own Court ; (4) and if any Prefentee of the
King be otherwife received, and the Incumbent put out without due Procefs, as afore is faid, the fame Incumbent fhall commence his Suit within a Year after the Indu£tion of the Prefentee :" ' (5) Our Lord the King confidering the great Mifchief of the Incumbent in this Behalf, hath o;dained and fta- blifhed, by the Affent aforefaid, That if any fuch Incumbent be put out of his Benefice without due Procefs in the Manner aforefaid, that the faid In- cumbent fo put out without Procefs, may be at large, and fue for his Remedy by the faid Statute, and be- gin his Suit in this Cafe at what Time fhall pleafe him, within the Year, or after, at his Will; and that as well for the Time paft, as for the Time to come, notwithftanding the Term fo limited by the faid Statute.'
