And if any School-mafler, or other Perfon, in(ru6ting or teaching Youth in any -private Houfe S(*oo)-maft«rt- or Family as a Tutor or School-mafter, (hall inftrui5t or teach any Youth as- a Tutor or School-mafter, Houfci!'* before Licence obtained from his refpe6tive Archbifhop, Bilhop or Ordinary of the Diocefe, according to the Laws and Statutes of this Realm, (for which he fhall pay twelve Pence only) and before fucn Subfcription and Acknowledgment made as aforefaid ; Then every fuch School-ftiailer and other, in- flruding and teaching as aforefaid, fhall for the firft Offence fufFer three Months Imprifohment without Bail orMainprize ; (2) and for every fecond, and other fuch Offence, fliall fufFer three Months Impri- fonment without Bail or Mainprife, and alfo forfeit to his Majefty the Sum of five Pounds : (3) And after fuch Subfcription made, every fuch Parfon, Vicar, Curate and Ledlurer, fhall procure a Certificate under the Hand and Seal of the refpedlive Archbifhop, Bifhop or Ordinary of the Diocefe, (who are hereby enjoined and required upon Demand to make and deliver the fame) and fhall publickly and openly read the fame, together with the Declaration or Acknowledgment aforefaid, upon fome Lord's Day within three Months then next following, in his Parifl^ Church where he is to officiate, in the Prefence of the Congregation there affembled, in the Time of Divine Service ; (4) upon Pain that every Perfon failing therein, fliall lofc fuch Parfonage, Vicarage or Benefice, Curate's Place, or Leifhirer's Place refpe^lively, and fhall be utterly difabled, and ipfo faSio deprived of the fame ; and that the faid Parfonage, Vicarage pr Benefice, Curate's Place, or Ledlurer's Place, fhall be void as if he was naturally dead. ■' XIL Provided always. Ecclefiaftical XIV. And be it further enacted by the Authority aforefaid. Provided that the Penalties in this A(5t fhall not extend to the Foreigners or Aliens of the Foreign Reformed Churches allowed or to be allowed by the King's Majefty, his Heirs and Succeflbrs in England. XV^I. Provided always. That no Title to confer or prcfent by I/ajafe, ftiall accrue by any Avoidance or Deprivation {ipfo fa£fo) by Virtue of this Statute, but after fix Months after Notice of fuch Avoidance or Deprivation given by the Ordinary to the Patron, or fuch Sentence of Deprivation openly and pub- lickly read in the Parilh Church of the Benefice, Parfonage or Vicarage becoming void, or Yhereof the Incumbent fliall be deprived by Virtue of this Aft. XVII.
