Penalty, Altered and explained by 7 &S W. 3. c. 30. §. 25. as aforefaid, before they be delivered out of the Cuflom-Houfe Warehoufe where they fliall be refpeftively ' imported and entred ; and all fuchLuflrings and Alamodes, which fhall be at any Time after the fifteenth Day of May one thoufand fix hundred ninety-four, imported, and not fo fealed and marked, fhall be for-' feited, and the Importers or Pofleflbrs thereof fiibject to fuch and the like Penalties and Forfeitures, as Im- porters of Ffe!?c/} Goods, by one A6t made in the firft Year of their iVlajelties Reign, intituled, Jn Aa for p-ohlbithig allTradc and Commerce ■with France, to be recovered as therein is direcled ; and if any Perfon or rerfons ihall alter or counterfeit the Mark or Seal, J^.larks or Seals, ufed and to be ufed for the Pur- pofes aforefaid, the Offender fhall forfeit the Sum of five hundred Pounds to any that will fue for the fame by Bill, Plaint, or Information, in any of their Majefties Courts of Pv.ecord at TVeJlminJler, wherein no Efloin, Protection, or Wager of Law, fhall be allowed, nor any more than one Imparlance. ,' XLVI. And whereas it is ena6led in one Aft of this prefcnt Seffion of Parliament, intituled. An ' ASl for granting to their Mnpjiks n,i Aid of four Shillings in the Pound for one Tear,, for carrying on a vrgo- ' rous IFar agaiiyflFnitict, Thzt for' the better fecuring the Trade of this ICingdom, over an'& above the ' ' Ships of War for the Line of Battle, and for Convoys to remote Parts, at the leafl: four Ships of the ' Third Rate, fixteen Ships of the Fourth Rate, thirteen Ships of the Fifth Rate, and ten Ships of the ' Sixth Rate, fhall be from Time to Time dire£ted and appointed by the Lord High Admiral of England ' or Commiffioners for executing the faid Office for the Time being, to fuch proper Stations as they fhall ' deem meet, to cruife, for fecuring the Merchant Ships in their going out and returning home:' Where-: fore, that it may the better appear how the faid Service is performed, vt'herein the Securky of Trade, andi th^ Safety of thefe Realms, is fo much concerned ; Be -it enacSted by the Authority aforefaid, That the Lord High Admiral of England, or the CommilTioners for executing the Office of Lord High Admiral of' England, for the Time being, fhall and are hereby refpedtively required to exhibit to the Commons affembled in Parliament, at the next Seffion of this or any other Parliament, which fliall happen after the lirft Day of Attgujlone; thoufand fix hundred ninety-four, a Certificate in writing under his or their Hands refpeftively, of the Ships by him or them refpecStively fet out in purfuance of the faid recited Claufe, ex- prciEng therein the Names and Rates of the Ships fet out, and the Times when -by him or them refpe£tivelyj ordered, as alfo the Stations to vi'hich they were directed, and the Times how long they were continued at Sea in that Service. • ^ XLVII. Provided always, and be it enacted by the Authority aforefaid. That the Officers of the Receipt of their Majefties Exchequer fhall and may receive and take, for their Fees, one Penny in the Pound, andi no more, for all or any the Sum or Sums of Money to be iffued or paid to any their Majeflies Garrifons, or other Land Forces and Armies, and other Charges incident to the fame, out of the Money arifing by thi.s or any other ASi and Grant of this Seffion, or any other Seffion of Parliament, during this prefent War;, to be diflributed in fuch Proportion as the Lord Treafurer, or Lords Commiffioners of the Treafury foi the Time being, fhall appoint, XLVIII. And to the End the great Duties of Excife, and the Powers given for the collefiing and levy- ing the fame, may not be employed for the influencing of Eleftions of Members to ferve in Parliamentj. which Eleftions, by the Conftitution of this Government, ought to be free and uncorrupt ; Be it enaftedj by the Authority aforefaid, That from and after the firfl Day of May in the Year of our Lord one thou-: fand fix hundred ninety-four, no Colledior, 'Supervifor, Gauger, or other Officer or Perfon whatfbever, concerned or employed in the charging, collciSting, levying, or managing the Duties of Excife, or an> Branch or Part thereof, fhalfbyWord, Meilage, or Writing, or in any other Manner whatfoever, endea- vour to perfuade any Elector to give, or difiTuade any Eleftor from giving his Vote for the Choice of any Perfon to be a Knight of the Shire, Citizen, Burgefs or Baron of any County, City, Borough or Cinq,uei Port to ferve in Parliament ; and every Officer or other Perfon offending therein, fhall forfeit the Sum oi one hundred Pounds, one Moiety thereof to the Informer, the other Moiety to the Poor of the Parifh whe^< fuch Offsnce fhall be committed, to be recovered by any Perfon that fliall fue for the fame, byAdion.oli Debt, Bill, -Plaint, or Information, in any of their Majefties Courts of Record at Weftminfler, in whidij no Efioin, Proteftion, Privilege, or "Wager of Law, Or more than one Imparlance, fhall be allowed; anc every Perfon conviiS' on any fuch Suit of the faid Offence fhall thereby become difabled and incapable 0: ever bearing or executing any Office or Place concerning or relating to the Duty of Excife,' or any othei Office or Place of Truft whatfoever under their Majefties, their Heirs or SucceiTors. XLIX. And it is hereby declared and ena£ted. That true Notes in Writing of the laft Gauges, made oi taken by the Gaugers, fhall be left by them with all Brewers, Makers, or Retailers of Beer, Ale, or otheii excifeable Liquors refpedtively, or fome of their Servants, at the Times of taking their faid Gauges, con- taining the Quantity and Quality of the Liquors fo gauged, upon the Penalty of five Pounds for ever) Offence or Negledt of the faid Gauger or Gaugers, to be_ recovered by any Perfon that fhall fue for tht fame by Aftion of Debt, Bill, Plaint, or Information, in any of their .ft4ajefties Courts of Record ai (Ve/hniii/Ier, in which no EfToin, Protedtion, Privilege, or Wager of Law, nor more than one Imparlance/ fhall be allowed.
