Provided always, That if any Perfon, who is intitled to the Penalties and Forfeitures by this Aft given, {hall compound with any Hundred, Port, or Place exempt, hereby liable to pay the fame, for any lefier Sum than what is hereby given ; that it fliall at any Time hereafter be lawful for any other Perfon to fue for and recover the fame in Manner and Form as aforefaid, as if no fuch Compofition had been made; and the Perfon fo compounding {hall for fuch his Offence fufler five Years Imprifonment without Bail or Mainprize : And this A6t to continue in Force for three Years, and from thence to the End of the next Sefllon of Parliament. An Afl for the better amending and repairing the Highways, and Explartation of the Laws relating thereunto. HERE A S many evil difpofed Perfons afTuming to themfelves the Names and Titles of the King's General or Deputy Surveyors of the Highways, and other Perfons, without any legal Authority for the fame, have of fate Years, by Threats, falfe Informations, and other illegal Ways, extorted and gotten great Sums of Money from feveral Owners of Waggons and Carriages of this Kingdom, under Colour and by Force of the wording of a certain Claufe in a certain Aft of Parliament (intituled, Jn ad- ditional ASifor the better repairing of Highways and Bridges) made in the two and twentieth Year of our late Sovereign Lord King Charles the Second, containing thefe Words, That from and after the four and twentieth Day of ^nne, therein mentioned, no Travelling Waggon, Wain, Cart, or Carriage, wherein any Burthens, Goods, or Wares are or /hall he carried (other than fuel] Carts and Carriages as are employed in and about Hujbandry, and manuring of Lands, and in the carrying of Hay, Straw, Corn unthrejhed. Coal, Chalk, Timber for Shipping, Materials for Building, Stones of aU Sorts, or fuch Ammunition or Artillery vjhich Jhall he for His Majejiys Service) Jhall at any Time travel, or he drawn, or go in any common or puhlick Highway or Road, with above five Horfe Beajls at Length ; and if any Jhall draw with a greater Number of Horfes or Oxen, they Jhall all draw in Pairs, that is to fay, two a-breqft, for fuch a Number as they Jhall ufe, except one Horfe, contrary to the Equity, true Intent and Meaning of the faid Claufe :' For Prevention of fuch Extortion and Oppreffion for Time to come, and the better Explanation of the faid Claufe ; II. Be it therefore enafted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament a{rembled, and by the Authority thereof. That for the better repairing and amending of the faid Highways, and the better Application of the Forfeitures in and about the fame, every Owner of any Waggon, Cart, Carriage, Horfe, Beafl:, or Oxen, offending contrary to this prefent A£l, fhall forfeit the Sum of forty Shillings, and no more, for every refpe£iive Offence, to the Surveyor or Surveyors of the Highways of the Pari{h> Town^ Village, or Hamlet, where any the faid Offences {hall be committed, to be paid to the Surveyor or Sur- veyors, and to no other Perfon or Perfons whatfpever ; which faid Forfeiture and Forfeitures {hall be levied in fuch Manner as the Penalties in the faid recited Aft, impofed on every Conftable or Surveyor of the Highways, for refufing or neglefting to put in Execution the feveral Afts of Parliament for or touching the repairing, amending, or enlarging of fuch Highways, are direfted and appointed, and no otherwifej and the faid Parifh Surveyor and Surveyors for the time being are hereby authorized and required to take and receive the faid Forfeiture and Forfeitures, and to pay in and account for the fame refpeftively upon Oath to the Juftices of the Peace at their Special SefJions holden once in four Months, purfuant to an Aft of Parliament in the fecond and third Years of our faid Sovereign Lord King William, and the late Queen of Gracious Memory, which faid Forfeiture and Forfeitures are to be employed in and about the Repairs of the Highways, in the refpeftive Parifh or Parifhes, Town, Village, or Hamlet, where fuch Forfeitures ars or were committed, according to the Direftion and Appointment of the laft mentioned Statute, and no otherwiie; any thing in the faid Aft of the two and twentieth of King Charles the Second, or any other Law or Statute, to the contrary thereof notwithftanding. ' III. And whereas by a Statute made in the two and twentieth Year of King Charles the Second, in- ' tituled. An Additional ASl for the better repairing of Highways and Bridges, it is enafted, That no Waggon, ' Wain, Cart, or Carriage (except as therein excepted) {hall at any Time travel or be drawn, orgoinany ' common or publick Highway or Road, with above five Horfe Beafls at Length, and if any fhall draw ' with a greater Number of Horfes, or Oxen, they fhall all draw in Pairs : And whereas, to avoid theln- ' tention of the faid Aft, the Waggoners have fixed an Iron or Shaft on the Side of the Waggon, v/hereby ' none of the Horfes go in a Line with the Wheels, and thofe which draw on the Side make the Rut deeper, ' and thereby the more impair the Highways :' For Remedy whereof be it enafted by the Authority afore- faid, That from and after the firft Day of Augujl, which fhall be in the Year of our Lord one thoufand fix hundred ninety and fix, no travelling Waggon, Wain, Cart or Carriage, wherein any Burthens, Goods, or Wares are' or {hall be carried or drawn for Hire (other than fuch Waggon, Cart or Carnages as a^e em- ployed
