D. 1697. • w. & M. ir. z. e.g. 7- Fine, Penalty, or Forfeiture, is or may be recovered by any Law or Laws of Excife, or by Aftion of Debt, Bill, Plaint, or Information, in any of His Majefly's Courts of Record at JVeftminfter ; and that one Moi- ety of every fuch Fine, Penalty, or Forfeiture, fhall be to His Majefty, His Heirs, and SuccelTors, and the other Moiety to him or them that fhall difcover, inform, or fue for the fame. An AB for the encouraging the diftilling Brandy and other Spirits ^ Ji-om Corn, andjor laying feveral Duties on Loiv JVi7ies, it was enafted and declared. That it fhould and
- might be lav/ful to or for any Perfon or Perfons, during the Continuance of that A61", to make, draw, or
' diftil, for Sale, or to be retailed, any Lpv/ Wines or Spirits from Drink brewed from malted Corn; up- ' on the Encouragemeirt of v/hich faid A£t many Perfons have, at great Charge, fet up Works for diftil- ' ling from Corn, and th^ faid Aft being fuice expired;' Be it therefore enafted and declared by the Au- Any Perfon may thority aforefaid. That it ilwll and may be lawful to or for any Perfon or Perfons, who have already fet up any Works or Offices, or who fhall hereafter fet up any Works or Offices for that Purpofe, and thereof fhall give Notice to the Commiffioners of Excife, within ten Days after the ere£ting fuch OfHce or Work, to make, draw, or diftil for Sale, or to be retailed, any Low Wines or Spirits from Drink brewed from malted Corn or Cyder, and to reftify and refine any fuch S|)irits of their own making only, paying the Duties, and being fubjeft to all Fines and Penalties as other Diftillers are; any Law, Charter, or other thing to the contrary notwithftanding. HEREAS feveral Perfons, as well Natives as Foreigners, Bodies Politick and Corporate, did ad- vance and lend, at the F^eceipt of Flis Majefty 's Exchequer^ very confiderable Sums of Money, upon the Security of the feveral and refpeftive Aids, Re^'enaes, or Funds, herein after mentioned ; that is to fay, upon the firft Aid of four Shillings in the Pound, payable out of Lands and other Things for one Year, by virtue of an Aft of Parliament made and pafTed in the fourth Year of the Reign of His Majefty and the late Queen of blefled Memory, whereby Intereft, not exceeding the Rate of feven Pounds per Centum per Annmn^ was allowed for the Sums borrowed in Purfuance thereof; and upon the third Aid of four Shillings in the Pound, payable out of Lands and other Things, for one Year, by virtue of an Aft of Parliament made and pafied in the fixth Year of His Majefty's Reign, whereby Intereft, not ex- ceeding the Rate of five Pounds per Centum per Annum, was allowed for the Sums thereby borrowed ; and upon the fourth Aid of four Shillings in the Pound, payable out of Lands and other Things, for od£. Year, by virtue of an Aft of Parliament made and pafled in the feventh Year of His Majefty's Reign, whereby Intereft, not exceeding the Rate of fix Pounds per Centum per Annum, is allowed for the Sums borrowed in purfuance thereof; and upon the Monies- which were to arife by an Aft pafled in the Par- liament holden at Wefminjler, in the fiifth and fixth Years of their faid Majefties Reign, whereby a Poll was granted to their Majefties, payable quarterly for one Year ; which Monies were direfted to be ap- plied to fatisfy the Principal of fuch Loans ; and upon the Monies which were to arife by the three fourth Parts of the Cuftoms, after Satisfaftion of the Principal and Intereft of five hundred thoufand Pounds charged thereupon by an Aft of Parliament in the fecond Year of their faid Majefties Reign; for which Loans fo made, and which were intended to be paid out of the three fourths of (he Cuftoms, the Lenders v/ere intitled to receive Intereft after the Rate of fix Pounds per Centum per Atinum. And whereas the greatcft Part of the Monies fo lent upon the Aids, Revenues, or Funds, before mentioned, hath been ac- tually falisfied and paid ofi^, but the feveral Terms, for which the faid refpeftive Aids of four Shillings ia the Pound, and the faid Poll Money, were granted, being determined and expired, and three hundred thoufand Pounds per Annum out ,of the Revenue of Cuftoms, being appropriated by Aft of Parliament to the Satisfaftion of other Loans, it doth plainly appear that the feveral Aids and Funds herein before mentioned are deficient, and could not fully fatisfy all the Monies v^hich were charged thereupon, and the Intereft thereof; and for fo much as remains unfatisfied, the refpeftive Lenders, their Executors, Admi- niftrators, and Affigns, have, or are intitled to have, in their Hands, Tallies and Orders of Repaym.ent levied and drawn according to the Forms ufed in his Majefty's Receipt oi Exchequer : And whereas by an Aft made and pafled in the Parliament holden at JVeftminfter -in the feventh and eighth Years of His Majefty's Reign, intituled, An A£i for cojitinuing to His Majefty certain Duties upon Salt, Glafs TFares, Stone and Earthen JVayes, and for granting feveral Duties upon Tobacco Pipes and other Earthen TVarcs, for carryim on the JVar againfl France, and for eflahVfinng a National Land Bank, and for taking off the Duties upon 1 unnage of Ships and npoii Coals, flis Majefty was impowered to borrow or take into the Receipt of the Exchequer any Sum or Sums of Money, either upon the Credit of Repayment by Orders to be regi- ftred and paid in Courfe, with Intereft after the Pv.ate o( kven Founds per Centum per Annum, or upon Credit of Bills to be made payable upon Demand, with Intereft' not exceeding the Rate of three Pence per Diem for every one hi:ndred Pounds, fo as that the principal Sums, which at anyone Timeihould be due and owing cither upon the faid Orders, or upon the faid Bills, or both, fhould not exceed the Sum of two millions five hundred fixty-four thoufand Pounds; and out of the Monies to be raifed by the Aft laft mentioned, it was direfted and intended, that the Sums following fliould be paid and applied, that is to fay, the Sum of five hundred and fixty thoufand Pounds to difcharge Monies which were Iciit at the Receipt of Exchcqtrr upon the Security of certain Duties upon Glafs "Wares, Stone and Earthen Bottles, Coals and Culm (which Duties upon Coals and Culm were taken away by the Aft laft mentioned) and the Intereft thereof, o^ie 'hundred and forty thoufand Pounds So anfwer and make good the Rates and '^- A ■ ' Duties
