For Remedy whereof, and for the Maintenance of the faid Trade of Fifliing, which doth fo Balkert, con- sieatlytend tothe Profit of many of the Inhabitants, within the faid Counties, and others,' (2) Be k^l^l'^'lJl^^ therefore enafted by our Sovereign Lord the King, the Lords Spiritual and Temporal, and the Com- the Grounds of mons, in this prefent Parliament allembled, That it (hall and may be lawful at all Time and Times hei'e- o"'|" " i;* after to and for all and every fuqh V/atchmen, Balkers, Huors, Condors, Diredors and Guidors, and all °^a"<='>v«l'^' fuch Filhermen and other Perfons as iliall neceffarily attend the faid Scans or Nets, as aforefaid, at the Times of Fifliing for Herrings, Pilchards and other Sean-fifli within the faid Counties where fuch Fiii fliall hereafter be taken, to enter and go into and upon any Lands, Tenements and Hereditaments which do lie or adjoin near unto any fuch Fifliing Places, and fit, convenient and necefl'ary to watch and balk in, or to draw and cany the faid Fidi on Shore, and there to watch for the faid Fi(h, and to balk, hue, cond, dired: and guide the P'ifliermen which (li^ll be upon the faid Sea and Sea-Coafts for the taking of the faid Fifh, and to draw and carry the faid Fifli on Land or Shore; any Law, Ufage or Cuftom to the contrary in any wife notwithftanding. And be it further enacted by the Authority aforefaid, That if any AcStion of Trefpafs or other Suit The Plea for * {hall at any Time -hereafter happen to be attempted and brought againft any Perfon or Perfons for en- q""*"^' i^^"^ tring and going on the Land for watching of the faid Fifli, or for balking, huing, conding, direding or Aai'on^of Tef. guiding of the laid Fifliermen in their Boats upon Sea or Sea-Coafts for taking of the faid Fifh, or for the pafs brought Landing of the (aid Fifli, as aforefaid, by Authority of this prefent Act, the Defendant or Defendants in^S^'oftf"™' any fuch Adion or Suit fli^Il and may plead Not guilty for any Thing doing by Virtue of this Act : (2) And upon the Trial of that Iffue, the whole Matter to be given on both Parties in Evidence according to the very Truth of the fame: (3) And after fuch Iffue tried for the Defendant or Defendants, or Nonfuit of the Plaintiff or Plaintiffs after Appearance, the fame Defendant or Defendants to recover his or their 'Damages, by reafon of his or their wrongful Vexation in that Behalf, with Coils alfo in that Behalf fuftained; (4) and that to be affeffed by the fame Jury that fliall try the faid Iffue; or elfe by Writ to enquire of the Damages as the Cafe fliall require; (j) for which Cofts and Damages fuch Defendant iliall and may by Virtue of this A&. tfike and fue forth fuch Execution as the Defendant in a Replevin may do. For Remedy and Redrefs whereof, be it enacted by the King's mofl: excellent Majefty, with the Affent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parliament aflembled, and by the Authority of the fame. That no Perfon or Perfons reiiant, .iidiabitant or dwelling viithin this Realm, fliall at any Time after the firfl: Day oi Augufl next coming make, weave or caufe to be made and weaved, any fuch Cloth or Clothes for Sails, or Furniture of Ships, or otiier failing Veffels, called, termed or, known by the Name or Names cii Mildernix ai;id Pozvk-Daz'ics, or any of them, but fuch as now do ufe the fame, or any of their Servants, or fuch as -fliall hereafter be Apprentices, "and trained and brought up in the Trade and Art of making of the faid Clothes by the Space of fcven Years together at the leaft; nor fliall fet ,any Man to work in the making or weaving of any fuch Clothes, being not a Work- man trained up before the firfl: Day oi Aagujl next coming in the faid Art and Myftery; (2) upon Pain that every fuch Perfon offending or doing the contrary, fliall forfeit and lofe for every Default twenty Shillings for every Montli.
