- Perfon who ftiall export fuch Plate, as hath been or fhall be made purfuant to that A(S, by lofing the
' Charge of the Fafliion in melting down the fame, and felling the Silver Abroad, the principal 1'hing
- aimed at to be prevented by the firft recited Act: But on the contrary a great Benefit may accrue to many
- Artificers, and to the Kingdom in general, by giving Liberty to export Watches, Sword Hilts, wrought:
' Plate, and feveral other Silver Manufaftures made within this Kingdom, being of the Finenefs prefcribed
- in the faid laft recited Act;' Be it therefore enaSed by the King's moft Excellent Majefty, by and with
the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament afiembled, and by the Authority of the fame. That from and after the four and twentieth Day of 'June one thoufand fix hundred ninety-eight, it fliall and may be lawful to export fuch Watches, Sword-hilts, wrought Plate, and other Silver Manufactures made within this Kingdom, being of the Finenefs of eleven Ounces and ten Penny Weight to every Pound Troy^ and fo proportionably for a greater or leffer Weight, accord- ing to the Rules prefcribed in the faid laft recited A£t, as fliall be yearly allowed by the Commiffioners of His Majefty's Cuftoms for the time being, or any three of them j any Law or Statute to the contrary in any wife notwithftanding. ' IL And whereas great Quantities of empty Boxes, Cafes, and Dial Plates, for Clocks and Watches, ' have been exported without their Movements, and in foreign Parts made up with bad Movements, and ' thereon fome London Watch-makers Names engraven, and fo are fold Abroad for EngUJh Work; and alfo ' there have been the like ill Praftices in England by divers Perfons, as well by fome profeffing the Art of ' Clock and Watch-making, as others ignorant therein, in putting counterfeit Names, as alfo the Names
- of the moft known London Watch-makers, on their bad Clocks and Watches, to the great Prejudice of
' the Buyers, and the Difreputation of the faid Art at Home and Abroad :' For the preventing therefore of all fuch ill Practices for the future, be it ena£ted by the Authority aforefaid. That no Perfon or Perfons whatfoever ihall, after the faid four and twentieth Day oiyune, export or fend, or endeavour to export or fend, out of this Kingdom oi England, Dominion oi Wales, or Town o^ Berwick upon Tweed, any outward or inward Box, Cafe or Dial-plate of Gold, Silver, Brafs or other Metal for Clock or Watch, without the Movement in or with every fuch Box, Cafe or Dial-plate, made up fit for Ufe, with the Clock or Watch- maker's Name engraven thereon ; nor any Perfon whatfoever, after the faid four and twentieth Day of June, fliall make up or caufe to be made up any Clock or Watch without engraving, or putting, or cau- fing to be engraven or put, his or her own Name and Place of Abode or Freedom, and no other Name or Place, on every Clock or Watch he or fhe fhall fo make up, or caufe to be made up, under the Penalty of forfeiting every fuch empty Box, Cafe and Dial-plate, Clock and Watch, not made up and engraven as aforefaid, and alfo for each and every of fuch OfFence the Sum of twenty Pounds, one Moiety whereof to be to His Majefty, His Heirs and Succeffors, and the other Moiety fliall be to him, her or them that fliall fue for the fame in any of His Majefty's Courts of Record, by Aftion of Debt, Bill, Plaint or Informa- tion, wherein no Effoin, Prote(3:ion or Wager of Law fliall be allowed, or more than one Imparlance; .any thing herein coatained, or any Law or Statute to the contrary thereof in any wife notwithftanding. An Aft to repeal the Aft made in the laft Seffion of Parliament, intituled, An A£f for Relief of Creditors, by making Compofition with their Debtor i^ in cafe two 'Thirds of Number and Value do agree. ' TX/^ ^■^^'^■'^^ ^" ^^^ made in the fecond Seflion of this prefent Parliament, held in the eighth ' V V and ninth Years of His Majefty's Reign, intituled. An ASi for Relief of Creditors, by makif?^ ' Compoftions with their Debtors, in cafe two Thirds in Number and Value do agree, hath not anfwered the End ' for which the fame was intended, in regard that notwithftanding the Provifions in the faid Adt for pre- ' venting Frauds in the making fuch Compofitions, many fraudulent Praiftices have been committed, by ■' m.aking pretended Agreements with Perfons who were not real Creditors, and for greater Advantages than ■' what were exprefled in fuch Compofitions; which Practices have (as there is juft Caufe to fear) occafioned ■* much Perjury:' For Remedy whereof be it enafhed by the King's moft Excellent Majefty, by and with rthe Advice and Confent of the Lords Spiritual and Temporal, and the Commons, in this prefent Parlia- ment afiembled, and by the Authority of the fame. That from and after the twenty-fourth Day oijune in the Year of our Lord one thoufand fix hundred ninety and eight, the faid A£t, and every Claufe, Mat- ter and 1 hing therein contained, fhall be repealed, determined, and of no Force. n. Provided neverthelefs, and be it enadted by the Authority aforefaid, That tli is Aft fliall not extend, or be conftrued to extend in any wife, to prejudice, make void, or impeach any Agreement or Compofition ■made, or which before the faid twenty-fourth Day of j^Mjf fhall be made, bona jide, and without Fraud, and which fiiall be performed from time to time, accordmg to the true Intent and Meaning thereof, nor any Order for the Difcharge of any Debtor out of Cuftody, made or which (hall be made in puri'uance of fuch Agreement and Compofition, and by virtue of the abovefaid A£t, or which is or fhall be within the Saving or Benefit thereof, before the faid twenty-fourth Day oijune, but that every fuch Agreement or Compofi- tion, whereupon any fuch Order of Difcharge is or fhall be made as aforefaid, fliall be good and efreiftual to all Intents and Purpofes, and every fuch Order of Difcharge is hereby ratified and confirmed ; and every fuch Agreement or Compofition, whereupon no fuch Order of Difcharge is or fhall be made as aforefaid, fliall be and remain of the fame Force and Efi^eCt (and no other) as if this prefent A6t had not been made; ■jior to pardon, indemnify, or difcharge any Perfon who hath incurred, or before the faid twenty-fourth Day olJune Ihall incur any Penalty or Forfeiture, by committing any Offence againft the faid At5t, but that
