C. 9. 147 ercifed, and put in Praftice for the raifing, levying, colIecSling, and anfwering the Subfidies and Du- ties hereby before granted, as fully and effediually as if the fame Articles, Rules, and Claufes, and every oftliem, were again particularly and at large recited and re-enadted in the Body of this prefent Aft : Except only as to fuch of the faid Articles, Rules, and Claufes, touching virhich other Provifions, Altc- Exception; rations, or Exemptions are made by any Aft or Afts of Parliament now in being ; w^hich other Provifions Alterations, or Exemptions fhall be obferved with refpeft to the Duties hereby granted, during the Con- tinuance of this Aft, in the fame Manner as they are to be obferved with refpeft to the faid Subfidies formerly granted, as aforefaid. III. And it is hereby further enafted and declared. That for every hundred Weight of Sugar refined in Drawback on England (and fo in Proportion for a greater or lefTer Quantity) which Ihall be exported out of this King- ^"^"nl'^",^;,'" dom, within or during the faid Term of three Years, there fhall be by this Aft repaid at the Cuftom- jj"^ ^" .expor - houfe to the Exporter, within one Month after the Demand thereof (over and above the Sum of three (,ver and above Shillings payable by the above recited Afts, or one of them) the further Sum of one Shilling, and no the 3s. more : Oath being firfl: made by the Refiner, that the faid Sugar fo exported was produced from brown and Mufcovado Sugar, charged by this Aft, and that, as he verily believes, the fame was imported from her Majefty's Plantations in Jmerica ; and that, as he verily believes, the Duty of the faid brov/n and Mufcovado Sui^ar, was duly paid at the Time of the Importation thereof, and that the fame was duly exported, her Majefty's Searcher alfo certifying the fnipping thereof, and all other Requifilcs duly per- formed, according to the Book of Rates.' IV,. And be it further enafted by the Authority aforefaid. That the Officers of her Majefty's Cuftoms, NoFeeforEn- or any of them, or any of their Clerks or Subftitutes, fliall not direftly or indireftly receive, take, or try, &c. demand any Fee, Gratuity, or P.eward whatfoever, from any of her Majefty's Subjefts or Aliens, for any Entry, Warrant, Debenture, Certificate, Cocquet, or other Matter or Thing, to be done or performed, hy them, or any of them, in relation only to the faid Subfidies of Tunnage and Poundage herein before granted ; on pain of forieiting for every fuch Offence the Sum of forty Pounds ( to wit) one Third thereof penalty aoI, to her Majefiry, and the other two Thirds thereof (befides Cofl-s of Suit) to the Party grieved, who may fue for the fame by Aftion of Debt, or of the Cafe, Bill, Suit or Information, in any of her Majefty's ■ Courts of Record :^t IVeJhniii/ier, wherein no Effoin, Proteftion, Wager of Law, or more than one Im- parlance fhall be allowed. •_ ' ' V. And whereas all Wines of the Growth 'or Produft of i^r^w^, or of any Dominions under the ' FrmJj King, are by feveral Laws and Statutes of this Realm liable to the Payment of feveral Duties ' upon the Importation thereof, and particularly by an Aft of Parliament made in the feventh Year of ' the Reign of his faid late Majefty King William the Third, intituled, Jn A5i for granting to his Ada- y-<ff^ j.c. 10. ' jejiy an additional Duty upon all French Goods and A'lerchandizes ; it was enafted ("amongft other Things) ' "that for every Tun oi French Wine imported within the Time therein mentioned, there fhould be paid ' five and twenty Pounds above the Duties before charged thereupon ; but by another Aft made in the ' eighth Year of the lame King's Reign, intituled, Jn Jil for granting to his Alcijejly a fwther Subfidy of %'^.%.<:. ttt' ' Tunnage and Poundage upon Merchandize imported^ for the Term oflivo Tears and three ^.arters, and an ad- ' dltional Land Tax for one Tear, for carrying on the War ngai n/iFra.nce, it was provided. of England, in Parliament allembled, being defirous to encourage the Trade to Portugal, and alfo to raife Monies for carrying on the prefent War, and other her Majefty's Occafions, do further grant to her Ma- jefty the additional Duty, herein 'after-mentioned, upon all French Wmes to be taken and condemned, or adjudged as lawful Prize ; and do befeech your Majefty that it may be enafted ; and be it enafted by the Authority aforefaid.
