D. 1707. cancy, he fhall be liable to pay Treble Damages with full Cofts of Suit to every Perfon that fhall be in- jured thereby, to be recovered as is herein after diredted. X. And be it further ena£ted by the Authority aforefaid, That all and every Memorials fo to be entred and regiftred, fhall be put into Writing in Vellum or Parchment, and brought to the faid Office, and in cafe of Deeds and Conveyances ihall be under the Hand and Seal of feme or one of the Grantors, or fome or one of the Grantees, his or their Heirs, Executors, or Adm.iniftrators, Guardians, t^r Truftees, attefted by two Witnefles, one whereof to be one of the Witnefles to the Execution of fuch Deed or Conveyance ; which Witnefs fliall upon his Oath, before the faid Regifter, or his Deputy, prove the figning and fealing of fUch Memorial, and the Execution of the Deed or Conveyance mentioned in fuch Memorial ; and in cafe of Wills, the Memorial {hall be under the Hand and Seal of fome or one of the Devifees, his or their Heirs, Executors or Adminiftrators, Guardians or Truftees, attefted by two WitnelTes, one whereof fhall upon his Oath, before the faid Regifter, or his Deputy, prove the figning and fealing of fuch Memorial, which refpeiStive Oaths the faid Regifter, or his Deputy, is hereby im- powered to adminifter. XI. And be it further enacted. That every Memorial of any Deed, Conveyance, or Will, fhall contain the Day of the Month, and the Year when fuch Deed, Conveyance, or Will bears Date, and the Names and Additions of all the Parties to fuch Deed or Conveyance, and of the Devifor or Teftatrix of fuch Will, and of all the Witnefles to fuch Deed, Conveyance or Will, and the Places of their Abode, and fhall expreis or mention the Honors, Manors, Lands, Tenements, and Hereditaments contained ia fuch Deed, Conveyance, or Will, and the Names of all the Parifhes, Townfhips, Hamlets, PrecincSts, or Ex- traparochial Places within the faid Ea/? Riding, and the faid Town and County of the Town oi King/ion upon Hull, or either of them, where any fuch Honors, Manors, Lands, Tenements, or Hereditaments, are lying or being, that are given, granted, conveyed, devifed, or any way affe£ted or charged by any fuch Deed, Conveyance, or Will, in fuch Manner as the fame are exprelTed or mentioned in fuch Deed, Conveyance, and Will, or to the fame Eft'eift ; and that every fuch Deed, Conveyance and Will, or Probate of the fame, of which fuch Memorial is fo to be regiftred, as aforefaid, Ihall be produced to the faid Regifter, or his Deputy, at the Time of entring fuch Memorial, who fhall indorfe a Certificate on every fuch Deed, Conveyance and Will, or Probate thereof, and therein mention the certain Day, Hour, and Time on which fuch Memorial is fo entred or regiflred, exprefling alfo in what Book, Page, and; Number the fame is entred, and that the faid Regifter, or his Deputy, fhall fign the faid Certificate- when fo indorfed ; which Certificates fliall be taken and allowed as Evidence of fuch refpeftive Re- giftries in all Courts of Record vk^hatfoever ; and that every Page of fuch Regifter Books, and every Me- morial that fhall be entred therein, fhall be numbred, and the Day of the Month, and the Year, and Hour, or Time of the Day, when every Memorial is regiflred, fhall be entred in the Margents of the faid Re- gifter Books, and of the faid Memorial ; and that every fuch Regifter fhall keep an alphabetical Calen- dar of all Parifhes, extraparochial Places and Townfhips, within the faid Enji Riding, and the faid Town, and County of the Town oi Kingjlon upon Hull, with Reference to the Number of every Memorial that, concerns the Honors, Manors, Lands, Tenements, or Hereditaments in every fuch Parifh, extraparochial Place or Townfhip refpeftively, and of the Names of the Parties mentioned in fuch Memorial, and that fuch Regifter fhall duly file every fuch Memorial, in order of Time, as the fame fhall be brought to the faid OfEce, and enter or regifter the faid Memorials, in the fame Order that they fhall refpe6tively~ come to his Hand. XIL And be it further enafted by the Authority aforefaid. That a Memorial of fuch Deeds, Convey-" ances and Wills as fhall be made and executed, or publiftied in London, or in any other Place not within forty Miles of the faid Eajl Riding, which do or may concern or afFedl any Honors, Manors, Lands, Te- nements, or Hereditaments in the faid Eaft Riding, or the faid Town and County of the Town of King- jlon upon Hull, ihali be entred or regiftred by the aforefaid Regifter or his Deputy, in cafe an Affidavit fworn before one of the Judges zt 1 1 ejhninfter, or a Mailer m Chancery, ordinary or extraordinary, ber brought with the faid Memorial to the faid Regifter, or his Deputy, wherein one of the WitnelTes to the Execution of fuch Deeds and Conveyances fhall fwear, he or (he faw the fame executed, and the Memo- rial figned and fealed, as aforefaid, or wherein one of the Witnefles to the Memorial of any Will fhall fwear, he or fhe faw fuch Memorial figned and fealed, as aforefaid ; and the fame fhall be a fufficient Autho- rity to the faid Regifter or his Deputy, to give the Party that brings fuch Memorial and Affidavit, a Cer- tificate of the regiftring fuch Memorial ; which Certificate figned by the faid Regifter or his Deputy, Ihall be taken and allowed as Evidence of the Regiftries of the fame Memorials in all Courts of Record whatfoever ; any thing in this Aft to the contrary thereof contained in any wife notwithftanding. XflL Provided always, and be it enacted, That where there are more Writings than one for making and perfe£ling any Conveyance or Security, which do name, menticn, or any Ways afFeiS: or concern the fame Honors, Manors, Lands, Tenements, or Hereditaments, it Ihall be a fufficient Memorial and Regifter thereof, if all the faid Honors, Manors, Lands, Tenements, and Hereditaments, and the Pa- , rifhes, Townfliips, Hamlets, or extraparochial Places, wherein the fame lie, be only once named or men- tio ed in the R'lemorial, Regifter, and Certificate of aiiy one of the Deeds or Writings made for the per- fedting of fuch Conveyance or Security, and that the Dates of the reft of the faid Deeds or Writings re- lating to the faid Conveyance or Security, with the Names and Additions of the Parties and Witnefles, and the Places of their Abodes, be only fet down in the Mem.orials, Regifters, and Certificates of the fame, with a Reference to the Deed or Writing whereof the Memorial is fo regiftred, that contains or expreffes the Parcels mentioned in all the faid Deeds, and Directions how to find the regiftring the iatne, i XIV.
