gjjius &c. tereft and Property of and in all and every Ship, VelTel, Goods, and Merchandize they fhall take in any Part oi Atnerica (being firft adjudged lawful Prize in any of her Majefty's Courts of Admiralty, and fub- jeft to the Cuftoms and Duties payable to her Majefty, as if the fame had been firft imported to any Part of Great Britain, and from thence exported, for and in Refpeft of all fuch Goods and Merchandize) to be divided in fuch Proportions, and after fuch Manner, as her Majefty, heir Heirs and SuccefTors fhall think fit to order and direft. That the ^"i 'ivateShTs ^^^ ^'S^i Admiral oi Great Britain, or the Commiffioners for executing the Office of Lord High Admi- of War. ^^^ °^ Great Britain for the Time being, or any Perfon or Perfons in any Part of America, by him or them impowered and appointed, fhall (at any Time during the prefent War, at the Requeft of any Britijh Ow- ner or Owners of any Ship or Veffel, giving fuch Bail and Security as has been ufually taken upon grant- ing Commiffions, or Letters of Marque, except only for the Payment of the Tenths of the Value of the Prizes which fhall be taken, to the L(*-d High Admiral) caufe to be iffued forth (in the ufual Manner) one or more Commiffion or Commiffions to any Perfon or Perfons whom fuch Owner or Owners fhall nominate to be Commander (or in cafe of Death fucceffively Commanders) of fuch Ship or Veffel, for the attacking, furprizing, feizing, and taking, by and with fuch Ship or Veffel, any Ship or Veffel, Goods, Ammunition, Arms, Stores of War, or Merchandizes belonging to, or poffeffed by any of her Majefty's Enemies, in any Sea, Creek, Haven, or River in America, not being within the Space of one hundred Leagues of any Part of Afia or Africa, whereof that Trade is already granted to the Eafl India Company; and that fuch Ship or Ships, Veffel and Veffels, Arms, Ammunition, Stores of War, Goods and Merchandizes whatfoever, with all their Furniture, Tackle, or Apparel fo to bs taken by or with fuch private Owner or Owners, Ship or Veffel, according to fuch Commiifion and CommtiTions, being Altered and eis- ^^^ adjudged lawful Prize in any of her Majefty's Courts of Admiralty in or for any of her Colonies or plained by 9 Plantations in America, fhall (fubjeft to the Cuiloms and Duties payable to her Majefty as aforefaid for Aanse.c.
