I'j. 337 afovefaid : All which faid Lifts /hall from time to time be produced and fliewn to any of the Captains or other Officers of any of her Majefty's Ships of War, demanding the fame : And if any Man or Men be- longing to any of her Majefly's Ships of War, fliall be found on Board any Merchant Ship or Veffel, or ■Privateer, whofe Name fhall not be contained in fuch Lift, as aforefaid, the Mafter or Commander of fuch Veifel or Privateer fhall forfeit to her Majefty, her Heirs and Succeflbrs, the Sum of twenty Pounds for ■ every fuch Man which fhall be fo found on Board, to be recovered in Manner as aforefaid. XIIL And for the better furniiTiing Seamen to ferve on Board her Majefty's Ships of War which ftiall Trading Ships be in or about the feveral Parts oi America, for annoying the Enemy, and protedling the 1 rade there, it is and Packet Boats hereby further enabled. That the Mafter or Commander of every trading Ship or Veflel, and every Packet to America, to Boat, which {hall from time to time, from and after the faid tv/enty-fifth Day oi April, be outward-bound, M^^rrs for tS and going for any Part of America, fhall be, and are hereby obliged (at the Defireof any of her Majefty's Queen's Ships Officers thereunto lawfully authorized, and at the Charges of her Majefty) to receive on Board, and carry there, &c. to the Port or Place, whereto fuch trading Ship, Veflel, or Packet Boat fhall be fo bound, and deliver to fuch Officer or Perfon, to whom they fhall be affigned, any Number of Mariners, Seamen, or other Per- fons aftually entred into her Adajefty's Service and Pay (over and above the Complement of Mariners or Seamen, which fuch trading Ship, VefTel, or Packet Boat ufually carries, or which fliall be fufficient for navigating the fame for fuch intended Voyage, not exceeding the Proportion of a fifth Part of the Num- ber of fuch ufual or fufficient Complement of Mariners, or Seamen) upon Pain of forfeiting twenty Pounds On Penalty. . for every fuch Seaman or Mariner, that he or they fhall refufe to take on Board and carry, to be paid and recovered, as aforefaid. « XIV. That her Majefty be, and fhe, her Heirs and Sue- Ships,Goods/&c, celTors are hereby impowered from time to time, during the Continuance of the prefent War, to grant or in any Parts of make any Ciiarter, Commiffion, or Grant, Charters, Conmiiffions, or Grants, for the better or more ef- •'^'"*'""^^ *'• feftual enrbling any Society or Societies, or particular Perfons, to join in any Expeditions or Adventures by Sea or Land, for the attacking, furpiifing, taking or deftroying any Ships, Goods, Moveables and Immoveables, Settlements, Faftories, Creeks, Harbours, Places of Strength, Lands, Forts, Caftles, and Fortifications, now or hereafter <?f or belonging to or poffefled by any of her Majefty's Enemies, in any Part or Parts of America, and for the better making and carrying on any Preparations for fuch Purpofe and Purpofcs, and for the making and afTuring to the Societies and Perfons which may be concerned, their And aflure to Jleirs, SuccefTors, Executors, Adminiftrators and Affigns, full and undoubted Properties, Rights, and tiiem whatShips, Titles of, in and to, and the full Enjoyment of all and every the Ships, Ammunition, Stores of War, ^'r '^^ fliall fo Goods, Chattels, Moveables and Immoveables, Settlements, Faftories, Places of Strength or Security, ^ ^' '^' Lands, Forts, Caftles, and Fortifications, now or hereafter of or belonging to, or polTeflcd by any of her Majefty's Enemies in any of the Parts Oi America, which fuch Society or Perfons fhall take or caufe to be taken from any of her Majefty's Enemies during this prefent War, together with all the Proceed, Profits, ^nd Advantages which may accrue of or by the fame, or any of them, with and under fuch Regulations, and in fuch Manner and Form, as her Majefty, her Heirs and Succeflbrs, fhall think fit, and at any Time ©r Times afterwards (although the prefent War fhould be then ended) by any further Grants or C'larters to coni:rm, corroborate, and further allure the PremifTes, and every or any of them to the faid Societies, and Perfons concerned, their and every their Succeflbrs, Heirs, Executors, Adminiftrators, and Affigns, fo as to enable them, and every of them, to have, hold, and enjoy the full Benefit thereof, according to the true intent and Meaning of this AiSf. XV. Provided always. Trade toAmerKa XVI. Provided neverthelefs, and it is hereby declared to be the true Intent and Meaning of this A£l:, No Ship to mo- and be it further ena£fed by the Authority aforefaid. That it fhall not be lav/ful to any Commander of any left the Subjeas of her Majeft-y's Ships of War, Privateer or Merchant Ship having Letters of Marque, to attack, fur- of Spain, in their prize, feize, take, deftroy, or ofl^er any Violence, Spoil, or Moleftation whatfoever between Rio laHacha, t^ "en' lUo' la ^' and the River Chagre on the Spanijh Coaft in America, or within five Leagues at Sea of any" Part of that Hacha and ihe Shore, to any Sloop, Barcolongo, Canoa, or other Boat, Goods, or Merchandizes belonging to any of Riper Chagre. the Subjedfs of Spain, who fhall be concerned in any Intercourfe of Trade with any of her Majefty's Sub- jedts, or to any Sloop, Barcolongo, Canoa, or other Boat, Goods, or Merchandizes belonging to any of Jier Majefty's Subjedis which fhall be found going to, or coming from any Port or Place within the Li- mits aforefaid. ' XVII. And whereas by an A(£l of Pari iam.ent made in the third and fourth Years of her Majefty's 3 fef 4 /^*s.c. 13, Reign, intituled. An AB for prohibiting all Trade and Commerce with France, it is, amongft other Things, enadted. That the feveral contraband Goods or Merchandizes therein particularly enumerated, fliall not ' be carried by any of her Majefty's Subjedfs to any Port or Place belonging to the Crov/n of Spain, nor any Trade whatfoever be permitted or allov^^ed with the Subjects of Spam for the faid contraband Goods ' or Merchandizes ; and forafrnuch as fome Doubts may arife concerning the Extent of that Claufe,' Be ■ it thejefore hereby further declared and enadled by the Authority aforefaid, That the fame ftrall not extend «r be conftrued to reftrain any of her Majefty's Subjedts from carrying any of the faid contraband Goods or Merchandizes to any Port or Place within the Limits aforefaid, but t fhall and may be lawful to or for Vol. IV.
