Provided always, and it is hereby enafted by the Authority aforefaid, That in cafe any Perfon or On Exportaticn Peribns whatfoever fliall, at any Time or Times after the firfl: Day oi July one thoufand feven hundred and of Gold Thread twelve, during the Continuance of the faid Duties on Gilt and Silver Wire, export, by Way of Merchan- j ju5^!_%nd e" dize, for any Foreign Parts, any Gold. or Silver Thread, or any Gold or Silver Lace or Frin|;e, made of Dcbenuuefrom Plate Wire fpun upon Silk, and fhall give fiifficient Security before the Shipping thereof for Exportation, theCuflomer, that the particular Quantities of fuch Thread, or of fuch Lace or Fringe, intended to be exported, as ^^- t-'olleflor to aforefaid, and every Part thereof, fliall not be relanded or brought again into Great Britain, and ftiall ta"k ^°""" make Proof upon Oath, or by fuch Affirmation, as aibrefaid, that the faid Gold and Silver Thread, or the faid Gold and Silver Lace, or Fringe, was aftually made after the faid firft Day of July one thoufand kvta hundred and twelve (which Securities fliall be taken in her Majefty's Name, and to her Ufe ; and the faid Oaths and Affirmations fhall be adminiftred by the Cuftomer or ColleiSor of the refpedive Port for fuch Exportation) that then and in every fuch Cafe, the faid Cuftomer or Colleitor fliall give to the Exporter thereof a Debenture, expreffing the true Kinds and Quantities of fuch Gold or Silver Thread, and Gold and Silver Lace or Fringe, fo exported or fliipped to be exported, and the Exportation or Shipping there- of being certified by the Searcher upon the faid Debenture, the Colledtor or Receiver for the faid Duties upon Wire (upon producing the faid Debentures fo certified to him) fhall forthwith pay a Drawback or Allowance, after the Rate of five Shillings for every Pound Weight jverdupois, of fuch Siver Thread, Lace, or Fringe, and after the Rate of fix Shillings and eight Pence for every Pound Weight Averdupoii, of fuch Gold Lace, Thread, or Fringe, out of the Monies of the faid Duties on Wire then in the Hands of fuch Receiver or Colleftor, without Fee or Reward; and if fuch Receiver or Collettor fhall not have Money in his PLinds to pay any fuch Debenture, then the refpedlive CommifEoners of the faid Duties upon Wire are hereby required to pay or caufe to be paid the faid Debenture out of any the Duties on Gilt or Silver Wire arifing by this Aft; any thing herein contained to the contrary notwithflanding. LXin. And be it further enafted by the Authority aforefaid. That all and every the Powers, Authorities, ■AH the Powers DireiStions, Rules, Methods, Penalties, and Forfeitures, Claufes, Matters, and Things, which in and by '" 12 Car. 2, an A&. made in the twelfth Year of the Reign of King Charles the Second, intituled, Jn ASi for taking Ej;cife^asto' aivay the Courts of Wards and Liveries, and Tenures in Capite, and by Knights Service, and Purveyance, and for be in Force for fettling a Revenue upon his Majejly in lieu thereof; or by any other Law in Force relating to her Majefty's Re- managing thefe venue of Excife upon Beer, Ale, or other Liquors, are provided, fettled, or eftablifhed, for managing. Duties, raifmg, levying, collefting, mitigating, or recovering, adjudging, or afcertaining the Duties thereby granted, or any of them (other than in fuch Cafe for which other Penalties or Provifions are made and prefcribed by this Aft) fhall be exercifed, pradlifed, applied, ufed, and put in Execution, in and for the managing, raifing, levying, collefting, mitigating, recovering, and paying the faid Duties upon Gilt and Silver Wire hereby granted, during the Continuance of this Aft, as fully and efFeftually, to all Intents and Purpofes, as if all and every the faid Powers, Authorities, Rules, Directions, Methods, Penalties, Forfeitures, Claufes, Matters and Things, were particularly repeated, and again enadled in the Body of this pre- fent Act. LXIV. And be it further enafted by the Authority aforefaid. That all Fines, Penalties and Forfeitures, All Fines to be in relation to the faid Duties by this AcSl impofed upon Gilt and Silver Wire, fhall be fued for, levied, f"^ ^" ^^ by and recovered, or mitigated, by fuch Ways, Means and Methods, as any Fine, Penalty or Forfeiture is i^^^Y^"'^ °' and may be recovered or mitigated by any Law or Laws of Excife, or by any Aftion of Debt, Bill, Plaint or Information, in any her Majefty's Courts before mentioned ; and that one Moiety of fuch Fine, Penalty and Forfeiture, relating to the faid Duties on Wire (not otherwife directed by this AcSj fhall be to her Majefty, her Heirs and SuccefTors, and the other Moiety to him or them that fhall difcover, inform, or fue for the fame. LXV. ' Provided always, and it is hereby enafted by the Authority aforefaid, That fuch Perfons as fhall Commiffioners be in puifuance of this Aft appointed Commiffioners for the Duties on Gilt and Silver Wire, to be made ^ •<^f= Doties in England, Wales, or Berwick upon Tweed, fliall and may have and exercife the fame or like Jurifdiftion, t° i'/j": t'le fame Power and Authority, and may adjudge, determine, mitigate or order, in all Cafes and Matters relating to the commffl'one^^ faid Duties on Gilt and Silver Wire arifing within the Limits aforefaid, as the Commiffioners of Excife up- of Excife. on Beer, Ale and other Liquors, may or lawfully can exercife, adjudge, determine, mitigate or order, in the like Cafes or Matters in relation to the faid Duties of Excife, by any Law or Statute now in ' Force. LXVI. And be it further enafted by the Authority aforefaid, That during the Continuance of the faid During this Aa. Duties upon Gilt and Silver Wire by this Aft granted, no Gold or Silver Thread, Lace, Fringe, or other ^^°*^°"!f'?"' Work made thereof, fhall be imported or brought into Great Britain, upon Pain of being forfeited, and ported.
