Stat. 2. 645 faid Ship or Vefle], as aforefaid; or in cafe any Perfon {hall moleft him, them, or any of them, in the fa- or hbdenng the ving of the faid Ship, Veflel or Goods, or (hull endeavour to impede or hinder the faving of any fuch Ship, favingthc ship, Veifel or Goods, or when any fuch Goods are faved, fhall take out or deface the Marks of any fuch Goods, •« make double Jbefore the fame fhall be taken down in a Book or Books for that Purpofe provided by the Commander or ^^"^^^•°"" ruling Officer, and the firfl: Officer of the Cuftoms, as aforefaid, fuch Perfon or Perfons fliall, vi^ithin the Space of twenty Days, make double Satisfadion to the Party grieved, at the Difcretion of the two next Juftices of Peace, or in Default thereof, fhall by fuch Juftices of Peace be fent to the next Houfe of Cor- reSion, where he fhall continue and be imployed in hard Labour by the Space of twelve Months then next enfuing ; and that it fliall be lawful for any Commander or Superior Officer of the faid Ship or Veflel Matters may fo in Diftrcfs, as aforefiid, or for the faid Officer of the Cufloms, or Conftables on board the fame Ship'^P^' PrtTers or Veflel, to repell by Force any fuch Perfon or Perfons as fhall, without fuch Leave or Confent from the '"'° ^^^ ^'^'P' faid Commander or Superior Officer, or the faid Officer of the Cuflroms, or his Deputy, or fuch Confta- bles, as aforefaid, prefs on board the faid Ship or Vefl^el fo in Diftrefs, as aforefaid, and thereby molefl: them in the Prefervation of the faid Ship or Veflel fo in Diftrefs, as aforefaid, IV. And it is hereby likewife enafled, That in cafe any Goods fhall be found upon any Perfon or Per- Ooodscarrie<l fons, that were flolen or carried off from any fuch Ship or Veflel fo in Diftrefs, as aforefaid, he, fh'e, or o^. V. And it is hereby moreover enafled. That if any Perfon or Perfons fhall make, or be affifting in the Making Holes making any Hole in the Bottom, Side, or any other Part of any Ship or VelTel fo in Diftrefs, as aforefaid, intheShip, or fhall fteal any Pump belonging to any Shipor Veflel fo in Diftrefs, as aforefaid, or fhall be aiding or ^'^- -^'W* abetting in the Stealing fuch Pump, as aforefaid, or fhall wilfully do any Thing tending to the immediate Lofs or Deftrudion of fuch Ship or VeflTel, fuch Perfon or Perfons fhall be and are hereby made guilty of Felony, without any Benefit of his, her, or their Clergy. VL And be it further enaiSed by the Authority aforefaid. That if any Aiiion, Suit or Information, General imie, fhall be commenced or profecuted againft any Perfon or Perfons, for any Thing that he or they fhall do, or caufe to be done, in Purfuance of this A6t, and executing any of the Powers and Authorities, or any of the Orders or Direftions therein mentioned, all and every Perfon and Perfons fo fued in any Court what- foever, fhall and may plead the General Iffue, and give this AQ. and the fpecial Matter in Evidence ; and if in any fuch Suit the Plaintiff or Profecutor fhall become nonfuit, or forbear Profecution, or difcontinue the Suit, or if a Verdidt fhall pafs againft him, or Judgment be given againft him upon a Demurrer, then in any of the faid Cafes, the Defendant or Defendants fhall recover full Cofts, for which he and they fhall have the like Remedy as where Cofts by Law are awarded ; and this AA fnall be taken and allowed in all Publick Aft. Courts within this Kingdom as a publick Act, and all Judges and Juftices are hereby required to take No- tice thereof as fuch without fpecial pleading of the fame. VII. Provided neverthelefs, if any Officer of the Cuftoms, or his Deputy fo impowered, as above, fhall, Cuftom. houfe by Fraud or wilful Negledl, abufe the Truft fo hereby repofed in him, as aforefaid, and fhall be convifted Officerabufing thereof in due Form of Law, fuch Officer, or his Deputy, fhall refpedively forfeit treble Damages to the i?'= T'"**' '° Party grieved, to be recovered in any A<Stion or Suit to be brought in any Court of Record, and fhall from D3ma"'^^^d thenceforth be fully difabled and rendred incapable of the fame, or any other Imployment relating to the difebled!' ^" iaid Cuftoms. Provided always, and it is hereby enadted, That neither this ASt, nor any Thing herein contained, claims to ihall any Ways extend to deprive, or any Ways prejudice her Royal Majefty, her Heirs or Succeflbrs, or Wreck faved, any claiming under them, or any of them, or any Patentee or Grantee of the Crown, or any Lord or Lords of any Manor or Manors, orother Perfon whatfoever, of or in relation to any Pvight which they, or any of them refpedtively have, or fhall have, or lawfully may claim to any Wreck or Wrecks, or any Goods that are or fhall be Floatfam, Jetfam or Lagan, but that fuch refpedf ive Rights fliall be enjoyed in as full, ample, and beneficial a Manner, in every Refpedl, as if this Adt had never been made. X.
