i3° C. 8. Anno tertio Georgii Regis. A. D. 1716. Money lent in Bills, equal to Specie at the Exchequer. Intereft on Bills -to be al- lowed by Re- ceivers Gene- ral, &c. to the Day of Paying. No Inter.-ft on Bills m Recei- vers, &c. Hands. Endowments to be made thereupon by the Payer, Bills ve-ifEied, Intereft to Bills to be re- iffl.ed only for ihe Principal Monev. Tellers tc be re-imburfed the Intereft they allow. Receiver Gene- ral- to keep a Boofe of all the Monies by' him received, &c«. his Hands, as aforefaid ; in. which Action the Plaintiff fhall or may declare, That fuch Receiver or Collec- tor is indebted to fuch Plaintiff" the Money demanded upon every fuch Bill, according to the Form of this Statute, and hath not paid the fame ; which fhall be fufricient : and the Plaintiff in every fuch Action fhal! recover againft fuch Receiver cr Collector, not only the Monies fo neglected or refufed to be paid, but alfo the Damages, befides full Colts of Suit, and fuch Receiver or Collector fhall be fubject and liable thereunto ; and in fuch Action, no Effoin, Protection, Privilege or Wager of Law fhall be allowed, or any more than one Imparlance ; and upon Payment of the Money fo to be recovered, the Plaintiff", his Executors or Affigns, fhall deliver up fuch Bills to the Defendant, his Executors or Aligns. X'XIX. And be it further enacted, That as any of the faid Bills amounting to two Millions five hundred fixty-one thoufand and twenty-five Pounds fhall Be paid or lent into the Exchequer by any of his Majeily's Receivers, or any other Perfon or Perfons, Bodies jfcikick or Corporate, making any Payments or Loans at that Receipt, the Officers there fhall caufe Tallies to be levied and delivered to the Payers or Lenders, as amply and effectually, to all Intents and Purpcfes, as if they had made fuch Payments or Loans in Specie. XXX. And be it enacted by the Authority aforefaid, That the Intereft which fhall, from Time to Time, be due upon any the Bills fo to be current, 'fhall be allowed to all Perfons, Bodies Politick or Corporate, paying the fame to any Receivers or Co' ! lectors, Receiver or Colieotor of any his Majefty's Aids, Taxes or Supplies, or by way of Exchange, as aforefaid, or paying or lending the fame into the Exchequer, as aforefaid, unto the respective Days whereupon fuch Bill or Bills fhall be fo paid, exchanged or lent. XXXI. Provided always, That no Intereft fhall run or be paid on or for any fuch Bill or Bills, during the Time that any fuch Bill or Bills fo paid, exchanged or lent, fhall remain in the Hands of any the faid Receivers or Collectors, or in the Hands of any Teller or Tellers of the Exchequer, but for fuch Time the Intereft on every fuch Bill fhall ceafe for the publick Benefit and Advantage, XXXII. And to the End it may be known forwhat Time fuch Bills fhal], from Time to Time, remain in the Hand, of fuch Receivers or Collectors, or in the Exchequer, as aforefaid ; Be it further enacted by the Authority aforefaid, That the Perfon or Perfons who fhall pay fuch Bill or Bills to any Receiver or Collector of any his Majefty's Revenues, Aids, Taxes or Supplies, by way of Exchange cr otherwife, or fhall pay or lend fuch Bill or Bills into the Exchequer, as aforefaid, fhall at the Time of making fuch Payment, Exchange or Loan, on each Bill fo paid, exchanged or lent, put his or their Name or Names, and write thereupon in Words at length, the Day of the Month and Year en which he, ihe or they fo paid, lent or exchanged fuch Bill or Bills; all which the laid Receivers and Collectors refpectively, and alfo the refpective Tellers in the Exchequer, fhall take care to fee done and performed accordingly ; to which refpective Days the faid Receivers and Collectors fhall be allowed again the Intereft which he, fhe or they fhall have allowed or paid upon fuch refpective Bill or Bills, upon his, her or their paying the fame into the Receipt of the Exchequer, as aforefaid. XXXIII. Provided alfo, and it is hereby further enacted by the Authority aforefa'd, That when any of the faid Bills fhall be re-iffued or paid again out of his Majefty's Exchequer, the refpective Teller there, : from whofe Office fuch Bill or Bills fhall be fo re-iffued or again paid out, fhall endorfe on fuch Bill or Bills fo re-iffued, in Words at length, the Day of the Month and Year that the fame were fo re-iffued or repaid out of the faid Exchequer, and alfo on what Account the fame were laft received into the Receipt of the Exchequer, and fign the fame, from which Time the Intereft on fuch Bill or Bills fo re-iffued or paid again fhall revive, and fuch Bill or Bills fhall again run and pafs at Intereft as the fame did before they were paid unto or exchanged by the faid Receivers or Collectors, or before the fame were paid or lent into- the Exchequer, as aforefaid. XXXIV. And it is hereby enacted by the Authority aforefaid, That the fame Bills to be re-iffued, from Time to Time, or at any Time, at the Exchequer, as aforefaid, fhall be fo re-iffued only for the Prin- cipal Money to be contained therein. XXXV. And to the End the refpective Tellers of the Exchequer, who fhall allow any Intereft upon fuch Bills which fhall be paid or lent into the Exchequer, as aforefaid, may be reimburfed the faid Inte- reft by them refpectively allowed ; It is hereby further enacted by the Authority aforefaid, That the Officer or Officers to be,_from Time to Time, appointed for receiving the Monies hereby appropriated for Pay- ment of che faid Intereft, fhall from Time to Time, out of fuch Monies in his or their Hands, reimbui fe and pay to the faid Teller and Tellers refpectively, fo much as he or they fhall have refpectively allowed for thr faid Intereft to the Payers or Lenders of fuch Bills ; in the do ng whereof he or they fhall obferve fuch Rule.s and Directions as he or they fhall, from Time to Time, receive from any three or more of the Commiffioners of the Treafury, or High Treafurer for the Time being. XXXVI. And be it enacted, That every Receiver General of any Revenues, Aids, Taxes or Supplies, belonging or to belong to his Majefty, his Heirs or Succefibrs, fhall keep a fair Book or Books of Accounts in Writing of all the Monies by him received ; in which he or his Deputy or Deputies fhall truly enter all the.Sums which ihall have been received by him or them for every fuch Revenue, Aid, Tax or Supply, together with the Names of the feveral Collectors from whom the fame, or any Part thereof was received, the Days when, and the Sums paid, how much thereof in Money, and how much in Exchequer-bills, and what Exchequer-bills fhall have been exchanged by every fuch Receiver General purfuant to this Act j to. which Accounts every Perfon concerned fhall have free Accefs at all feafonable Times without Eee or Charge ; and the faid Accounts fhall conftantly lie open at one certain Place within the Limits of his Re- ceipt for that Purpofe ; and if fuch Receiver mail neglect to keep fuch Book or Books, or to enter therein. any
