And be it further enacted by the Authority aforefaid, That from and after the faid four and twen- No Ma'tfer to tieth Day of June one thoufand feven hundred and twenty no fuch Maltfter or Maker of Malt for Sale orP ermit his Cora Txportation fhall caufe or permit any Corn or Grain, by him, her or them making into Malt, to be worked t0 bc a< = rel 'P ,red ' or made in fuch Manner that the fame (hall acrefpire (that is to fay) run out, grow or fprout at that End bc making or working, {hall fufpect the fame, or fome Part thereof, to be acrefpired, as aforefaid, fdien acrefpired. and in fuch Cafe it may be lawful for fuch Supervifor or Supervifors, Officer or Officers, or any of them, to take out of any particular Part of' the Floor of fuch wetting of Corn or Grain fo making into Malt, as he or they fhall fo fufpect to be acrefpired, fo much thereof as he or they can conveniently take up with one Hand at one Time, and to examine the fame to fee if it be be acrefpired, as aforefaid, or not; and in cafe Penalty on upon Examination thereof it fhall appear that more than one Part in fifteen of fuch Corn or Grain, f Maltftcr - t.iken up by the Hand, is acrefpired, as aforefaid, the intire Wetting of Malt, whereof fuch Corn or Grain fo taken up by the Hand' was Part, fhall be deemed, taken and charged as acrefpired Malt, and the Maltfter or Maker thereof fhall be charged with the full Duty of fix Pence per Bufhel for every Bufhel of Malt of - that wetting, and fhall not have any Allowance out of the fame, for or in refpeet. of its being charged upon the Floor, or elfewhere ; and fhall alfo forfeit and lofe for every Bufhel of the faid Malt, the further Sum of five Shillings; any Act or Acts of Parliament to the contrary thereof in any wife notwith- standing. REP. III. Provided always, and bc it further enacted by the Authority aforefaid, That the refpective Super- Officers iifco. vifor or Supervifors, Officer or Officers, who (hall difcover fuch acrefpired Corn or Grain making into J?"?, B ' t0 f : " Malt, as aforefaid, fhall within the Space of eight and forty Flours next after the refpective Time or Times t6°Milx!iaa? when the fame fhall be difcovefed, give or leave Notice thereof in Writing with or for the refpective Malt- fters or Makers of fuch Malt, or with fame or one of his, her or their refpective Servants; on pain of for- feiting the Sum of forty 'Shillings for every Neglect of fuch Notice.
