And whereas by an Act paffed in the third Year of the Reign of her late Majefty Queen Anne, ' Jt 4 -"-""■ c - 4- t intituled, An Aft for continuing 'Duties 'upon Low Wines, and upon Coffee, Tea, Chocolate, Spices and PU- c tares, and upon Hawkers, Pedlars and Petty Chapmen, and upon Mujlins ; and for ; granting new Duties upon ^ feveral of the faid Commodities, and atfo upon Callico, China PFare and Drugs, It is enacted, That any Per- ' fon or Perfons may import into this Kingdom, Nutmegs, Cinnamon, Cloves, Mace and Tea, fubject to ' the feveral Duties payable for the fame, from any Parts beyond the Seas, in Britijl) Ships, navigated as ' therein mentioned, and fo as Notice be firft given to the Commiffioners of her Majefty's Cuftoms of the ' Quantity and Quality of the faid Spices and Tea fo intended to be imported, and the Place to which they ' intend to import the fame, and taking a Licence under the.Hands of the faid Commiffioners for the time 8 Ann. c. 7. ' being for the Landing and importing thereof as aforefaid : And whereas by an Act palled in the eighth feft. ij. c Year of the Reign of her faid late Majefty, intituled, An Aft for granting to her Majefty new Duties of
- Excife, and upon feveral imported Commodities, and for other Purpofes therein mentioned, It is enacted,
' That Nutmegs, Cinnamon, Cloves and Mace, may be imported into Great Britain, fubject to the feveral ':* Duties payable for the fame, from any Parts beyond the Seas, in Britijl) Ships, navigated as therein men- ' tioned, the Importer thereof firft giving Notice to the faid Commiffioners of the Quantity and Quality of ' the faid Spices, and the Place into which he intends to import the fame, and taking a Licence under the
- Hands of the faid Commiffioners for the importing thereof, which Importation is to be continued during
' the Continuance of the laid refpective Acts, which are ftill in Force : And whereas many ill-difpofed ' Perfons having taken out Licences for great Quantities of the faid Spices and Tea, do import the fame at ' feveral Times in fmall Parcels, with Intent fecretly to land the fame as Opportunity fhall offer; but if ' the faid Spices or Tea are found by the Officers of the Cuftoms on board the Ship, the Importers to pre- ' vent the Seizures thereof, do produce their Licences, and pretend that thofe Spices or Tea are Part of ' the .Quantities mentioned in the faid Licences, whereby there is good Reafon to fufpedt that great Frauds ' are frequently committed, to the leffeningof his Majefty's Revenue, and Prejudice to the fair Merchant:' In every ticence Be it therefore enacted and declared by the Authority aforefaid, That in every Licence to be granted from for importing and after the firft Day of Augift one thoufand feven hundred and twenty, in Purfjance of the faid Acts, Nutmegs,. and during their Continuance, for the importing of Nutmegs, Cinnamon, Cloves, Mace and Tea, fhall be and Pkce of expreffed the Quantity and Quaiity of the faid Spices and Tea, and the Place or Port into which the fame Landing to be are intended to be imported ; and that if any greater Quantity of the faid Spices or Tea fhall be imported, expreffed, &c. than what is exprelTed in the faid Licence, the fame fo imported ftiall be deemed to be imported without a Repealed as to Licence ; and fuch Licence fhall and may be granted without any Fee or Reward by the Commiffioners or l?eab'v7Geo°i e ^' ie f Managers of the Cuftoms for the Time being, or any three or more of them, or by the Cuftomer or Stat. 1. c. 21.' ' Collector and Controller of the Port into which the faid Spices and Tea are to be imported, fo as that all feci. is>. Nutmegs, Cloves, Mace and Cinnamon, to be imported into this Kingdom by Virtue of fuch Licence, from any Place or Places beyond the Sejs, other than directly from the Eafl Indies, be not in any other Package than in Cafks or Bales ; which Cafks or Bales fhall contain the Quantity hereafter mentioned, that is to fay, each Cafk of Nutmegs, Cloves or Mace to weigh neat three hundred Pounds Weight, or upwards, each Bale of Cinnamon to weigh neat feventy Pounds Weight, or upwards. Licence to be XLVI. And be it further enacted, That the Licence fo taken out for Spice and Tea as aforefaid fhall be t' Ve '"th" P sr' delivered to the Merchant demanding the fame ; which Licence fhall be produced and delivered up by the Enforced by * Mafter, Purfer or other Perfon taking Charge of the Ship wherein fuch Spice or Tea fhall be imported, 8 Geo. 1. c. iS. with the Name of the Ship and Mafter, together with the Marks and Numbers of each Cafk, Bale or Par- feel, ai, eel, and the Quantity and Quality of fuch Spice or Tea indorfed on the Back thereof, to the Collector and Comptroller of the Port into which the fame fhall be imported, at the Time of his or their entring the Ship ; any Law, Cuftom or Ufage to the contrary notwithftanding. Ep-.c.s in Bagstr < XLV XL And whereas fuch Spices are frequently imported in Bags and other fmall Parcels packed in ^forfeited. 8 ' Hogfheads, Cafks', Bales or other Package, in order to run the fame clandeftinely :' Be it enacted by the Concerning $ pices Authority aforefaid, That if any of the Spices above mentioned fhall be found on board any Ship or VefTel fesfarthir% Ga. in Bags or other fmall Parcels packed in Hogfheads, Cafks or Baks, the fame fhall be forfeited ; one Moiety i.e. 15../W?. 15, whereof to be to the Ufe of his Majefty, his Heirs and Succeflbrs, and the other Moiety to him or them < f 8 ,. c? '^ who will inform or fue for the fame in anv of his Majefty's Courts of Record at Weflminfter, or in the Court ' of Exchequer in Scotland, wherein no Effoin, Protection or Wager of Law (hall be allowed. 8 Ann. c, 13. ' XLV I II. And whereas by an Act of Parliament of the eighth Year of the Reign of her late Majefty ' Queen Anne made, (amongft other Things) for better preventing Frauds in Drawbacks, it was enacted, ' That no Debenture lhould be paid or allowed for any Tobacco exported from any Port of Great Britain ' to the Kingdom of Ireland, until a Certificate fhould be produced under the Hands and Seals of the Col- ' lector, Comptroller and Surveyor of the Cuftoms of any Port in Ireland, or any two of them, where fuch ' Goods fhould be landed, teftifying the Landing thereof (the Danger of ihe Seas or Enemies exceptej): ' And whereas it frequently happens, that Tobacco imported into this Kingdom, and afterwards (hipped ' again for Ireland, doth in the Carriage thither wafte and decreafe in Weight, but as the Law now ftands ' no more Drawback can be allowed, than for the Quantity of Tobacco particularly fpecified in the faid An Allowance <■ Certificates returned from Ireland:' Now for the Encouragement of all fair Traders that fhall fend To- be made for T*.
