C. 23. 409 ronct, late Sub-Governor, Charles Joy, Efquirc, late Deputy-Governor, and William Ajlell, Efquire, Sir Lambert Blackiuell, Baronet, Sir John Blttn Baronet, Sir Robert Chaplin, Baronet, im Chapman, Knight and Baronet, Robert Che/ler, Efquirc, Stephen Child, Efquire, Peter Delaport, Efquire* Francis Eyles, Efquire, James Edmonjim, Efquire, Edward Gibbon, Efquire, John Gore, Efquire, Sir William Hammond, Knight, Francis Halves, Efquirc, Richard Hor fey, Efquire, Richard Houlditch, Efquirc, Sir Theodore Jan/Jen, Knight and Baronet, Sir 'Jacob Jacob/on, Knight, Arthur Ingram, Efquire, Sir' John Lambert, Baronet, Sir Harcourt Majler, Knight, William Mor/ey, Efquire, Atmr, Pa -.-, Efquire, Colonel Hugh Raymond, Samuel Read junior, Efquire, Thomas Reynolds, Efquire, Jacob Sawbiid Efquire, William ftllard, Efquire, and John Turner, Efquire, late Directors ot the Corporation ol Governor and Company of Merchants of Great Britain trading to the South-Seas, and other Parts of America, and for encouraging the Fifhery, commonly called the South-Sea Company, in the f.iid Act named, and alio Robert Knight late Treafurcr or Cafhier, Robert Srmnan late Deputy-Calhier, John Grigsby late Accountant to the (aid Corporation, and John Aijlabie, Efquire, every or any of them, or any in Truft for them, every or any of them, upon the firft Day of June Anno Domini one thoufand feven hundred and twenty, or at any Time or Times afterwards, or which James Craggs the elder, Efquire, deceafed, or ^any Perfon or Perfons in Truft for him at the Time of his Death, was or were feiled or pofl'efled of, or intcrcftcd in, or entitled unto, in Law or Equity in their or any of their own Rights, or to his or their own Ufe or Ufes, or in Partnerfhip with any others (except as in the laid Act is afterwards excepted) were, by Force and Virtue of the faid Act, veftcd and fettled in Sir John Eyles, Baronet, Sir Thomas Croft, Baronet, John Rudge, Mathew Lant, Rodger Hud/on, Efquires, now Sir Roger Hudfon, Knight, Edmund Halfey, John Lade, Gabriel Roberts and Richard Hopkins, Efquires, thereby nominated and appointed Truftees for the Ufes and Purpofes in the faid Act exprefled of and concerning the fame, and the Heirs, Executors, Adminiftrators and Affigns of the fame Truftees, fro n the refpedtive Times in the faid Act named, to the Intent the fame might be fold and difpofed of, or othcrvvife applied to and for the Ufes and Purpofes in the faid Act exprefled concerning the fame, and that the clear Monies arifing thereby fhould be appropriated to and for the Ufe of the South-Sea Com- pany, in fuch Manner as is therein mentioned ; and it is thereby enacted, that the Entries of fucli Claims, as by the faid Aft are directed, by or for any Perfons or Corporations in Great Britain, fhould or might be made at any Time before the twenty-fifth Day of December one thoufand (eve;- hundred and twenty-one, and by and for any Perfon or Perfons refiding or being beyond the Seas, or out of Great Bri- tain, fhould or might bemade at any Time before the twenty-fifth Day of March one thoufand feven hun- dred and twenty-two : And whereas in and by the faid Act it is further enacted, That the faid Truftees, or any three or more of them, fhould and might enquire and inform themfelves, by or upon the Teftimony of Witneffes upon Oath, or by the Examination of the Perfons making fuch Claims upon Oath (all which Oaths they, or any one or more of them, had thereby Power to adminifter) or by the Infpec- tion of any Mortgages, Bonds, Bills, Notes or other Securities, or any Accounts relating to the faid Debts, or any of them fo claimed, or by Inflection of any Grants, Gifts, Settlements, Conveyances, Transfers or Affurances relating to the faid Eftates, Interefts or'Incumbrances fo claimed, or any of them, or by all or any the faid Ways and Means, or othervvife, according to their Difcretions, as loon as conveniently might be, touching all or any the Debts, Eftates, Interefts or Incumbrances fo claimed, and fhould make a Report or Reports in Writing of their Proceedings therein, with their Opi- nions thereon, from time to time, to the Court of Directors of the faid South-Sea Company for the Time being ; and if the faid Court of Directors for the Time being fhould be fatisfied in the Juftice of fuch Claim or Claims, or that any Debt or Sum of Money ought to be paid thereupon, or that the Eftate, Intereft or Incumbrance fo claimed, or any Part thereof, ought to be allowed, and fhall declare their Satisfaction therein, by any Refolution or Refolutions of that Court ; and if the Party or Parties by or for whom fuch Claim fhould be made, fhould likewife in a Book or Books to be kept in the faid, Truftees publick Office for that Purpofe, declare in Writing under his, her or their Hands, his, her or their Acquiefcence in fuch Refolution or Refolutions of the faid Court of Directors for the Time be- ing, touching his, her or their Debt, Eftate, Intereft or Incumbrance fo claimed, a: any Time or Times before the firft Day of Augujl one thoufand feven hundred and twenty-two ; then in all and every fuch Cafe and Cafes, the faid Truftees, or any three or more of them, fhould give Warrant for the Payment and Dilcharge of every fuch Debt or Sum of Money fo liquidated or adjufted, out of fuch Monies as fhould come to the Hands of the Cafhier of the faid South-Sea Company for the Time being, for the Purpofes in the faid Act exprefled ; and it was by the faid Act further enacted, That the Juftices of the Courts of King's Bench and Common Pleas, and the Barons of the Coife of the Exchequer for the Time being, or any three or more of them, fitting at the fame Time and Place, and not otherwife, fhould, and they were thereby authorized, from time to time, to hear and determine all Differences, Difputes and Controverfies, touching or concerning any Debts, Eftates, Interefts or Incumbrances which fhould be claimed within the refpedtive Times therein before limited for making fuch Claims, and could not or fhould not be liquidated or adjufted between the faid Court of Directors for the Time being, and the refpedtive Claimants within the Time before limited in that Behalf, and all Incidents relating thereunto, in fuch Manner as by the faid Act is directed ; and by the faid Act it is enacted, 7 Geo. i, Stat, i; That the faid Juftices and Barons, or any three or more of them, upon a Complaint to be made, by or c - zS - for any Claimant, of any fuch Debt, Eftate, Intereft or Incumbrance, whofe Claims fhould not be liquidated or adjufted as aforefaid (fo as fuch Complaint be made on or before the five and twentieth Day of December one thoufand feven hundred and twenty-two) fhould proceed in fuch Manner as by the faid Act is directed ; and the faid Juftices and Barons, or any three or more of them, in all Cafes where they fhould find that any Debt or oum of Money ought to be paid to fuch Claimant upon fuch Vol. V.
