C. 5. 477 ' taments not regiftred, whereof he, fhe or they, or any Perfon or Perfons in Truft for him, her or ' them, was or were feifed in Fee-fimple, or otherwife interefted in at the Time of fuch Default as albre- ' faid, two third Parts thereof to the King, and the other third Part thereof to fuch Perfon or Perfons, ' being a Proteftant or Proteftants, who fhould fue for fuch forfeited Lands, Tenements or Heredita- ' tnents as fhould lie in England, the Dominion of IVales, and Town of Berwick upon Tweed, in any ' fuch Court, and by fuch Ways or Means as were directed by the faid therein recited Aft to oblige ' Papifts to regifter their Names and Real Eftates, and fhould fue in his Majefty's Court of Exchequer ' iii Scotland for fuch forfeited Lands, Tenements or Hereditaments as fhould lie in that Part of Great Bri- ' tain called Scotland: And whereas the greateft Part of the Perfons required by the faid Acl to take the ' aforefaid Oaths, on or before the faid five and twentieth Day of December, have, in Te-ftimony of their ' Loyalty to his Majefty, and their Zeal and Affection for his facred Perfon and Government, and the ' Proteftant Succeflion in his Royal Houfe, and in Obedience to the faid Act, talcen the faid Oaths ; but ' by Reafon of the Shortnefs of the Time allowed for that Purpofe, many Perfons have been prevented ' from taking the fame ; and the Time limited for taking and fubferibing the faid Oaths, and fubferibing ' the faid Afturance, within that Part of Great Britain called Scotland, has been found not to be fufficient ; ' and divers Doubts and Queftions have arifen, and may hereafter arife upon the faid recited A<5r, as well ' in Refpeevt of the Defcription of the Perfons thereby required to take the faid Oaths, or to take and ' fubferibe the faid Oaths, and fubferibe the faid Aifurance, as of the Confequences and Effects of the ' Penalties and Forfeitures thereby inflidted :' Now, for the taking away and quieting all fuch Doubts and Queftions, and for the preventing all Inconveniencies that might happen by Means thereof; Be it enafted and declared, &c. " No Woman obliged to take the Oaths, &c. nor Reverfioners, &c. Perfons indemnified from Penal- " ties, &c. for not having taken Oaths, &c. Thofe that have negle&ed to take the Oaths, &c. taking " them on or before 28 November 1724, difcharged from regiftring, &c. And in Default to regifter their " Names, &c. on or before 24 June 1725. Clerks of the Peace in England to return Copies of Regifters " into the Exchequer by 29 Sept. 1725, and the Keeper of the General Regiftry in Scotland to do the like " there. Stat, 2. thoufand Pounds for publick Services, by Sale of Annuities, after the Rate of five Bounds per Centum per An- c " J 9" num, redeemable by Parliament, and to authorise a Treaty concerning private Rights claimed by the Proprietors of the Sugar- Houfes in Scotland, a certain yearly Sum of forty-five thoufand five hundred Pounds was eftablifhed to be a diftinct and feparate yearly Fund for anfwering and paying certain Annuities, after the Rate of five Pounds per Centum per Annum, which were then to be purchafed upon the fame Act, until the Redemption thereof by Parliament ; and the faid yearly Fund was thereby directed to be iftued at the Exchequer to the firft and Chief Cafhier of the Governor and Company of the Bank of England for the Time being, by way of Impreft, and upon Account, for Payment of the faid Annuities, which were to be purchafed upon that Act; and it was thereby enacted, That the Monies which fhould be contributed on the fame Act for or towards the Sum of nine hundred and ten thoufand Pounds therein mentioned, fhould be deemed to be a Capital or Joint Stock on which fuch Annuities fhould be at- tending ; and the fame Joint Stock, .and the proportional Annuities attending the fame, were thereby made transferable and dcvifeable in the Manner thereby prefcribed ; and in the faid Act is. contained a Provifo, That at any Time upon one Year's Notice, and Repayment by Parliament, of the laid Sum of nine hundred and ten thoufand Pounds, or fo much thereof as fhould be advanced upon the faid Act, unto the refpective Contributors of the fame, or to fuch Perfon or Perfons as by, from or under them, .
