« V V Second, intituled, An Ail for making the Rivers Wye and Lugg, and the Rivers and Brooks run- 4 ning itito thefame, in the Counties of Hereford, Gloucefter and Monmouth, navigable, Sir William Sandys 4 Knt. Windfor Sandys, Efquire, and Henry Sandys, their Heirs and Afligns, were impowered upon the 4 Terms and under the Provifoes in the faid Act mentioned, to make the faid Rivers navigable ; but the faid 4 Sir William Sandys, Windfor Sandys and Henry Sandys, having not done any Thing to the River Luvg, and ' what Work was done on the River Wye, being performed very flightly, all the Powers, Authorities, Pri- 4 vileges, B ene hts an d Advantages whatfocver, given and granted to them the faid Undertakers, by Virtue 4 of the faid recited Act, by an Act paffed in the feventh and eighth Years of the Reign of his late Majefty ' King William the Third, intituled, An Acl for making navigable the Rivers Wye andLugg in the County 4 of Hereford, were vefted in the feveral Truftees therein named, wich feveral other Powers and Authori- 4 ties in the faid laft recited Act mentioned ; and whereas moft Part of the Truftees named in and by the 4 faid laft recited Act are dead, and no Provifion made by the faid Act for filling up the Room or Place of

  • any Truftee or Truftees dying, by taking in the Heir or Heirs of the deceafed Truftees, or otherwife,

' whereby the Number of Truftees is reduced to a few, and the due Execution of the Powers of the faid 4 recited' Acts have been very much hindre'd and obftructed, and will foon become impracticable, unlefs 4 fome timely Means be applied :' For the Remedy of the faid Inconveniencies and Defects, and for the better and more cflectua! accomplifhing of the Ends and Defigns intended for the Good and Service of the Publick by the faid recited Acts, Be it therefore enacted, &c. " Truftees for putting this and the two former Acts in Execution. All the Powers in the former Acts veft- "' ed in them. New Truftees on Deaths ihall be elected, Truftees may fummon Perfons to account on 44 Oath for Monies, &c. in their Plands. Truftees may fummon Perfons to give Evidence. All Papers " Vouchers, &c. to be delivered up to the Truftees. On Refufal Truftees have their Action at Law, and " treble Cofts. All the Money, &c. acquired by the Act 7 & 8 W. 3. and by this Act, fhall be applied in " fuch Proportions as prefcribed by that Act, viz. i'o much as is unapplied, and allotted to the River Wye, " to be paid over to Perfons nominated by the Truftees for the River Wye, and the other Part unapplied
