of Authority aforefaid, That the Commiffioners of his Majefty 's Treafury now being, or the High Trea-tb pay efie Fund, lurer, or Commiffioners of the Treafury for the Time being, fhal], from and after the faid Feall of the Birth of our Lord Chrift one thoufand feven hundred and fifteen, quarterly, at the four mod ufual Fcafts in every Year, that is to fay, the Feafts of the Annunciation of the blefled Virgin Mary, the Nativity of Saint John Baptift, Saint Michael the Archangel, and the Birth of our Lord Chrift, or within twenty Days next after every of the faid Feaft-Days, caufe a true and exact Account to be made of all the Monies which, on or before the faid refpective Quarter-Days within the Quarter then ended, fliall have come, or was brought into the Receipt of Exchequer, of the faid Duties and Revenues, and Surplus Monies, or any of them, for or towards Payment of the faid increafed Fund, and the faid yearly Sum for Charges; and if upon making every or any fuch Account, the Monies fo come or brought in (hall appear to fall fhort of one fourth Part of the faid yearly Sum of ilx hundred thoufand Pounds, and eight thoufand Pounds, for the preceding Quarter of a Year, then, and fo often, and in every fuch Cafe, all and every Sum and Sums of Money, fo deficient, (hall, upon Demand to be made by the faid Governor and Company, or their Cafhier, by Writing under the common Seal of the faid Governor and Company, or figned by the faid Cafhier, and to be left with or for the Treafurer of the Navy of his Majefty, his Heirs or SuccefTors, for the Time being, at or in the Houfe or Place u fed by fuch Treafurer of the Navy for the Time being, for making Pay- ments for the Ufe of the Navy, or within twenty Days after fuch Demand, be anfwered, made good, and fa- tisfied by the Treafurer of the Navy, for the Time being, of his Majefty, his Heirs and Succeflbrs, out of any Decency >o Monies then in his Hands or Power, or firft coming to his Hands or Power, for the Service of the Navy, or £ e ^r^Tfu- the Victualling thereof; all which Monies are hereby charged to make good the faid Payments which lhall be r l r ,h c N av j-, incurred and grown due to the faid Governor and Company from Time to Time, with Preference to any &c. other Payments to be made out of the fame for any Ufe or Service whatfoever; and the faid Payments to the faid Governor and Company, or their Cafhier for their Ufe, fhall be made without Fee or Charge, and without any further or other Warrant to be fued for, had or obtained from his Majefty, his Heirs or Succeflbrs, or any other Perfon or Perfons whatfoever ; and the faid Treafurer of the Navy for the Time being, is hereby authorized and required (in default of fpecifical Money to anfwer the Payment of any Inch Deficiency or Deficiencies, as aforefaid) forthwith to difpofe fo much of any Tallies, Orders, An- nuities, or other parliamentary Securities, which then or afterwards (hall or may be in his Hands or Power, for the Service of the Navy, or the Victualling thereof, as will be fufficient to enable him to difcharge the Deficiency then due to the faid Governor and Company; and within twenty Days after fuch Demand, as aforefaid, to pay the fame in Money without any Deduction, Difcount or Abatement to be born or fuf- tained by them ; and fuch Treafurer of the Navy, from Time to Time, fhall be allowed upon his Account in the Exchequer all fuch Payments fo made by him ; and the faid Treafurer of the Navy fhall alfo be allowed all fuch Lofs as fhall happen by difpofing fuch Securities, upon the Oath of the faid Treafurer (which the proper Auditor hath hereby Power to adminifter) verifying the Truth thereof. VII. Provided always, and be it further enacted, That if the Treafurer of the Navy of his Majefty, his Treafurer of ti-.e Heirs or Succeflbrs, fhall at any Time or Times refufe or delay to make fuch Payment and Appiicaions, Navy not paying as aforefaid, of any of the publick Monies which fliall be in or come to his Hands or Power, or (in default ! °>tats his OF- of fpecifick Money) to fell and difpofe of any the Tallies, Orders, Annuities, or other parliamentary ' x ~" Securities, which fhall be in or come to his Hands or Power, and to apply the Money arifing by fuch Sale or Difpofition, or fo much thereof as fhall be fufficient for that Purpofe, for or towards making good fuch Deficiency or Deficiencies of the faid annual Sums of fix hundred thoufand Pounds, and eight thoufand Pounds, or either of them, as fhall have incurred or become due, according to the true Meaning of this ■ prefent Aft, when and as often as any fuch Deficiency fhall happen, fuch Treafurer of the Navy fhall forfeit his Office or Place, and fhall be liable to pay unto the faid Governor and Company, and their Succeflbrs, the Value of all and every Sum and Sums of Money fo refufed or neglected to be paid, with treble Damages and full Colls of Suit ; the fame to be recovered by the faid Governor and Com- pany, and their Succeflbrs, by Action of D^bt, or of the Cafe, Bill, Plaint or Information founded upon this Act, in any Court of Record of his Majefty, his Heirs or Succeflbrs, wherein no Eflbin, Protection, Privilege of Parliament, or other Privilege whatfoever, Wager of Law, or more than one Imparlance fliall be granted or allowed. ' VIII.
