  • XVII. And whereas it may happen, that feveral Arrears of the faid Duties upon Houfes, Windows, or

' Lights, granted by tlie i'aiU former Ads, may from time to time remain unfatisfied and unpaid, which ' ought to have been levied and paid at the Times and in tlie Manner by the faid Acts directed ;' Be it there- fore enacled and dechired by the Authority aforefaid, That in all fuch Cafes it (liall and may be lawful to and for the refpedtive Ferfons, who are or lliall be nominated or appointed Commiflioners for putting the faid former and this prefcnt AiPc in Execution for the time being (being duly fworn and qualified as aforefaid iii that Behalf) or fo many of them as are thereby impowered to caufe the faid refpciStive Duties to be aflcfied, levied, and paid, to caufe the Monies, fo from time to time in Arrear and unpaid as aforefaid, to be raifed, levied and collefted by the refjiedtive Colleftors of the feveral Parifhes or Places, Shires or Boroughs, where fuch Arrears fhall happen, by the fame Ways and Means, and in the fame Planner, and under the like Penalties, as are direcEled and appointed by the faid former or this prefent A6t, with refpedl to the raiung or levying the faid Duties; and the Monies fo received by the faid Colledlors for any fuch Arrears, fhall be paid to the refpe£tive Receivers General where fuch Arrears fhall happen, to the end the fame m,ay be paid into the Receipt of his Majefty's Excheqiier, for the Purpofes in the faid Acts mentioned. ' XVIII. And whereas Doubts have arifen, in what Manner the faid Duties {hould be rated and paid ' within the feveral Inns of Court and Chancery,' Be it further enacted and declared, That every Inhabi- tant, or Occupier of any Chamber in the faid Inns of Court or Chancery, fhall be rated and pay for every Window or Light in his Chamber the Sum of one Shilling. XIX. Provided always, That no Inhabitant or Occupier of any fuch Chamber fhall be compelled to pay. Chambers, not or to contribute towards the Payment of the Duty of two Shillings, charged by the faid Aft, and made

uty IS. -^-^^ And be it further enaded by the Authority aforefaid. That if any Aftion, Plaint, Suit or Informa- Officers, &d. ^jgj^ {hsW be brought, commenced or profecuted againft any Commiffioner or CommiiTioners, All'efibr or the"^^" AfTeffors, Colle£tor or Collectors, Surveyor or Surveyors, or other Perfon or Perfons, for or concerning any A£t, Matter or Thing, that he, they, or any of them, flialj do or caufe to be done, in purfuance or Execution of the faid A£t, or of this prefent A6t, in England, t-Faks, or Berwick upon Tweed, fuch Perfon or_ Perfons fo fued in any Court whatfoever, fhall and may plead the General Iflue, Not Guilty, and upon Ifltie joined, may give the faid Adt, and this prefent Aft, and the fpecial Matter in Evidence; and if the Plaintiff fliall become nonfuit, or forbear further Profecution, or fufFer a Difcontinuance ; or if a Verdift pafs againft him, the Defendants fhall recover treble Cofls, for which they fhall have the like Remedy, as in Cafes where Cofts by Law are given to Defendants. ' XXI. And whereas it hath been found by Experience, that the Powers granted by the faid Aft for ' charging,_ raifmg, levying and collefting of the Duties aforefaid upon the Windows or Lights liable to ' the fame in that Part of Great Britain called Scotland, have been ineffeftual :' Be it fui'ther enacted by the Authority aforefaid. That the Surveyor or Surveyors, appointed or to to be appointed as by the faid Aft is direfted, ihall have Power, twice in the Year, to enter into, and pafs through any Houfe or Houfes, within Und for viewing a,iy Cjjy or Royal Burgh in Scotland, and view the fame internally as well as externally, and to view any ^ °^' other Floufe or .Houfes m Scotland cx.itvn-aY, and in like Manner, as Surveyors are impowered to view Houfes by the faid Aft, for the Purpofes in the faid Aft m.entioned ; any thing therein contained to the con- trary notwithflanding. _XXII. And be it further enafted, That the faid Rates and Duties, by the faid Aft granted as aforefaid, with refpeft to Lights or Windows of Dwelling-houfes in Scotland, liable for the fame, fhall be paid by the Inhabitants or Occupiers for the time being, of the refpeftive Dwelling-houfes in which fuch Li"-hts or V/indows are contained, his, her or their Heirs or Executors refpcftively Half-yearly, at the Days of Pay- ment following ; that is to fay, the twenty-ninth Day of September and twenty-fifth Day of Mar J:, by even and equal Portions ; the flrft Payment thereupon to be made the twenty-ninth Day of September which fnall be in the Year of our Lord one thoufand (even hundred and forty-eight, for the Half Year, com- mencing from the Term of IFhitfunday, and ending at the Term of Adartininas in the faid Year ; and the fecond Payment to be made the twenty-fifth Day of March aforefaid which fhall be in the Year one thou- f.ind feven hundred and forty-nine, for the Half Year, commencing from the laid Term of Martinmas one thoufend feven hundred and forty-eight, and ending at the Term of JVhitjunday in the Year one thoufand feven hundred and forty-nine, and fo on Half-yearly thereafter.
