Terms, according to the Plan laid before the Houfe of Commons in that Seffion of Parliament ; and that they fliould lay their Proceedings therein, with their annual Accounts, before his Majefly and both Houfes of Parliament, refpe£i:ively : And it was by the faid Aft, for the Reafons therein contained, provided and enadled, That out of the Rents and Profits of the faid Eftate, then remaining in the Receipt cf his Ma- jefly's Exchequer, there fliould and might be iflued and paid to the Lord Vifcount Gage in the Kingdom of Ireland, the Sum of two thoufand Pounds without Account, and clear of all Fees and Deductions ; ia which faid laft recited ASt is contained a Saving to his Majefly, his Heirs and Succeffors, of all fuch Right, Title, Eftate, Intereft, Claim and Demand, of, in, unto, or out of the faid Premifles, as his Alajcl'ly, his Heirs and Succeffors, might have had, or been intitled unto, in cafe that AGt had never been made ; other than and except fuch Right, Title, Eftate, Intereft, Claim and Demand, as was vefted in his Alajefly, his Heirs and Succeffors, by virtue of the feveral Attainders before-mentioned, or of the therein recited Acts of Parliament ; and other than and except fuch Right, Title, Eftate, Intereft, Claim and Demand, v/hich his Majcfty, his Heirs and Succeffors, had or might have in or to fuch Part or Parts of the faid Pre- miffes, which ftiould be fold purfuant to the DirecStions of that ASt : And therein alfo is contained a Sa- ving to the feveral Mortgagees and Incumbrancers before-named (till they fhould be paid off as afore- faid) and to all other Perfons, of all fuch Right, Title, Eftate, Intereft, Claim and Demand, of, in, unto, or out of the faid Premiffes (except fuch Part or Parts thereof, which fliould be fold purfuant to the Di- recPcions of that Acl) as they might have had, or been intitled unto, in cafe that AA had never been made : And whereas by an A£t made in the eleventh Year of the Reign of his prefent Majefty (intituled, Jn Jsi for explaining and amending an ASi of the eighth Tear of hh prefent Majeftfs Reign, Intituled, An Aft for the Application of the Rents and Profits of the Eftates forfeited by the Attainders of fames late Earl o( Der- wentvjater, and Charles Radcllffe) it was enafted. That upon the Death of his prefent Majefty, and alfo upon the Death of every fucceffive King and Qiieen of this Realm, all fuch Afts and Services fliould be done and performed, and all fuch Fines and Sums of Money fhould be paid by the refpefti'e Tenants of the Eftates to every Succeffor of his Majefty, or (in cafe any of the faid Eftates fliould be fold) to fuch. other Perfon who fliall be the Owner thereof, as by the antient Tenure thereof, or by any Contraft, Law, Ufage or Cuftom, ought to be done, performed and paid by them, in cafe fuch King or Queen fo dying, was confidered as a private Perfon only, and not in his or her Politick Capacity ; and that for De- fault of Performance of fuch Afts and Services, which ought to be fo done and performed, and for Default of Payment of any fuch Fines and Sums of Money, which ought fo to be paid, fuch Forfeitures and Pe- nalties fliould accrue and become due, and it fhould be lawful for his Majefty, his Heirs and Succeffors, and for all Perfons by him or them appointed, or who fliould be then Owners of the faid Eftates,^ to ufe and take all fuch Ways and Means for recovering and taking Advantage of the faid Forfeitures and Penal- ties, as might be lawfully ufed or taken by any Lord of the faid Eftates, in cafe fuch King or Queen fo dying was confidered as a private Perfon only, and not in his or her Politick Capacity ; and that all the faid Fines, Sums of Money, Penalties and Forfeitures, which fhould accrue and become due to his Ma- jefty, his Heirs and Succeffors, during his and their Intereft therein, fhould be applied to and for the Ufe and Benefit of the Royal Hofpital for Seamen at Greenwich ; and the Attorney General of his Majefty, his Heirs and Succeffors, by his or their Direftion, was impowered by the faid Aft to apply to his Ma- jefty's Court of Exchequer at Wcfimlnfler, by Motion, in a fummary Way, for the Sale of all, or of fuch Part or Parts of the Timber on the faid Eftates, while the fame fhould remain unfold, from time to time, and at all Times, as fhould be thought fit ; and the Money arifing by fuch Sale or Sales, was to be applied by the Direftion of the faid Court, to the Difcharge of the Incumbrances with which the faid Eftates then ftood charged ; and in the mean Time was to be paid by the Purchafers into the Court of Exchequer, or to the Treafurer of the faid Hofpital for the time being, or to be placed out in fuch Government or other Securities, and in the Names of fuch Perfons, as the faid Court fhould direft ; and in cafe there fhould happen to be any Surplus of the faid Money, the fame was to be applied in the firft Place, for and towards the finifliingand completing the Building of the faid Royal Hofpital ; and after the Building of the fame Royal Hofpital fliould be completed and finifhed, for and towards the Support of the faid Royal Hofpital, for the better Maintenance of the Seamen of the faid Royal Hofpital worn out and become decrepit in the Service of their Country ; and after the faid Incumbrances fhould be totally difcharged, then all the Pro- duce of, or Money arifing by the Sale or Sales of any Timber on the faid Eftates, was to be, from time to time, and at all Times, wholly appropriated and applied to the Ufe of the faid Hoipital : And it was by the faid Aft enafted. That for or towards the Difcharge of the aforefaid Mortages and Incumbrances (except the faid Annuity of one hundred Pounds a Year) and not otherwife, it fhould and might be law- ful to and for the Attorney General of his Majefty, his Heirs and Succeffors, by his and their Direftion, to apply to his Majefty's faid Court oi Exchequer, by Motion, in a fummary Way, for the Sale or Sales to any Perfon or Perfons, being Proteflants, of the Fee-fimple and Inheritance of any of the faid Premiffes fo forfeited, and vefted in his Majefty as aforefaid, which were not charged with the faid Mortgages and Incumbrances, as fhould be thought moft convenient to be fold and difpofed of, and the Money arifing by fuch Sale or Sales v/as to be appfied, by the Direftion of the faid Court, for or towards the Difcharge of the faid Incumbrances, or fome of them, and in the mean Tiine was to be paid by the Purchafers into the Court of Exchequer, or to the Treafurer of the faid Hofpital for the time being, or to be placed out in fuch Government or other Securities, and in the Names of fuch Perfons, as the iaid Court fliould direct ; and in cafe there fliould happen to be any Surplus of the faid Purchafc-money, the fame was to be applied for the Benefit of the faid Hofpital : And it was by the laid laft- recited Aft alfo enafted. That it ihouli and might be lawful for his Majefty, his Heirs and Succeffors, during the Continuance of his or their Eftate in the Premiffes, by Sign Manual, to authorize the Commiffioners and Governors of the faid Hof- pital, or any feven or more of them, to demife and grant all the Mines of Lead, Coal, and other Mine- rals, as well unopened as opened, within and under the fiiid Lands and Premiffes, for any Number of ' Years,
