Power given to liis Maji-fty to borrow Money on the Sinking Fundj to pay off unfubfcribsd Annuities, The reciuced i^nnnities made payable and transfcrrable as the four per Cents, Boots 'o be O'/iened for ta- king in the Siiblcripcions, OfTicers to at- tend m Office Hours, be advanced, or fo much thereof as (hall be advanced as aforefaid, and all and ever>' the Annuities payable for or in refpeit of the fame, fliall be free of all Taxes, Charges and Impofitions whatfoever ; and fliall be affignabie or transferrable in a Book or Bucks to be provided for that Purpofe, in the Office of the faid United Company, in fuch Manner as the faid Commiflioners of the Treafury, or any three or more of them now being, or the faid High Treaftirer, or any three or more of the Commiflioners ot the Treafury for tiie time being, fhall direcS in that Behalf, without Fee or Gratuity, and free from all Charges; and tliat the faid Annuities fhall be deemed and taken to be a Perfonal, and not a Real Eftate, and fhall goto the Executors or Adminiftrators of the Perfon or Perfons dying pofTeffed thereof, interefted therein, or in- titled thereunto, and not to the Heir at Law ; fubjeft neverthelefs to fuch or the like Provifo or Condition of Redemption by the Publick, as the faid Sums of three million two hundred thoufand Pounds, and one million, due to the faid Company, would be fubjeft, in cafe fuch Subfcription by the faid Company, »i or before the faid thirtieth Day of Altiy one thoufand feven hundred and fifty, and the faid Sums had then re- mained due from the Publick to the faid Company. VI. And be it enafted by the Authority aforefaid. That the feveral Powers given to the faid United Com- pany, by feveral Afts of Parliament now in Force, of raifing Money by Bonds under their Common Seal for the carrying on the Trade of the faid Company, and lending Money on Bottomry, and otherwife, as in the faid A£ls, fome or one of them is mentioned, fhall continue and be in Force, but that the Amount of the Sums which the faid United Company fhall raife by Sale of Annuities by virtue of this Act, as afore- faid, fliall be by them applied towards the Difcharge of their prefent Bond Debt ; and fhall be computed and confidered as Part of what they are fo impovvered to borrow. VII. And be it enafted by the Authority aforefaid, That it fliall and may be. lawful to and for the King's mofi: Excellent Majefly, by Warrant under his Royal Sign Manual, to authorize and impower the Com- miflioners of the Treafury, or any three or more of them now being, or the High Treafurer, or any three or more of the Commiflioners of the Treafury for the time being, to raife by Loans or Exchequer Rills, or by Way of Subfcription, or in fuch other Manner or Form as his Majefty fhall, in his great Wifdom, think moft for the Advantage of the Publick, from any Perfon or Perfons, Bodies Politick or Corporate, any Sum or Sums of Money, not exceeding fuch Part of the National Debt, carrying an Interelt of four Pounds per Centum per Annum, redeemable by Law, as hath not been fubfcribed in purfuance of an A&. of this Seffion of Parliament, and fhall not be fubfcribed according to the Propofal herein before m.entioned, to be charged on the Sinking Fund, and to be applied to pay ofF and redeem fuch Part of the National Debt fo unfubfcribed as aforefaid, upon any Terms not exceeding the Rate of Interefc in the aforegoing Propofal mentioned. VIII. And be It further enafted by the Authority aforefaid. That the feveral Annuities of four Pounds per Centurn per Annum, now payable in refpe£l of the faid Principal Sum unfubfcribed by the Proprietors thereof, and by this Aft continued to them until the twenty-fifth Day ai December one thoufand feven hun- dred and fifty, as alfo the feveral reduced Annuities of three Pounds ten Shillings /ifr C^;i.';w/ per Annum, and three Pounds per Centum per Annum, by this Aft made payable in lieu thereof from the refpeiTtive Days therein mentioned, fhall, during the refpeclive Continuances thereof, be paid and payable to the refpeftive Perfons and Corporations intitled thereunto, their Executors, Adminiftrators or AfTigns, at the fame refpec- tive Offices and Places, and out of the fame Duties, Revenues and Incomes, and at fuch Time and Times, and fhall be aflignable, transferrable and difpofable in the fame Manner and Form, as the faid Annuities of four Pounds per Centum per Annum are now payable, aflignable, transferrable and difpolable by the rsfpec- tive Afts and Statutes now in Force, for or concerning the fame, and as if this pt-cfent A61 had never >etn made; fubjeft neverthelefs to Redemption by Parliament, from the faid twenty-fifth Day of £)iYt-;/;iirr one thoufand feven humired and fifty-five, in Manner herein after mentioned; any thing herein contained to the contrary thereof in any wife notwithflanding. IX. And be it further enacted by the Authority aforefaid. That there fhall forthwith be prepared and kept in the Office of the Auditor of the Receipt of the Exchequer, and alfo at the refpeiftive Offices of the Go* vernor and Companv of the Bank oi England, and of the Governor and Company of Merchants of Great Britain, trading to the South Seas, and for encouraging the Fifhery, commonly called the South Sea Company, a Book or Books for taking in Subfcriptions, or receiving the Confent of fuch Perfon or Perfons as now are or fhall be intercfled in, or intitled unto, any Part of the faid now unfubfcribed Annuities or Interefts, after the iaid Rate of four Pounds per Centum per Annum, who are willing to accept of an Annuity of three Pounds ten Shillings /)i.-r Centum per Annum in lieu thereof, from the faid twenty-fifth Day of December one thoufand feven hundred and fifty, until the faid twenty-fifth Day of December one thoufand feven himdred and fifty-five ; and of an Annuity of three VonnAs pcr^Celltum per Annum, from the faid twenty-fifth Day of December one thoufind feven hundred and fifty-five, to the End the Proprietors of the faid Annuities, af- ter the faid Rate of four Pounds per Centum per Annum, may make their Subfcriptions, and give their Con- fents in the faid refpedlive Book or Books, under a proper Preface to be prepared for th 't Purpoic, by fub- fcribing their refpeftive Sums and Names, with his, her or their refpeftive proper Additions ; which faid Books fhall conftantly lie open at the faid Receipt of Exchequer, and other the Publick Offices aforefaid, for that Purpofe, every Day.
