C. 7. 641 the next Juftice of the Peace of any County, Riding, City or Place, or Chief Magiftrate of any City or Town Corporate (not being an Officer of Marines) and before fuch Juftice or Chief Magiftrate he or they (hall be at Liberty to declare his or their DiiTenc to fuch Inlifting; and upon fuch Declaration, and returning the Inlifting-money, and alfo each Perfon fo diffenting paying the Sum of twenty Siiil- lings for the Charges expended or laid out upon him, fuch Perfon or Perfons fo inlifled fiiall be forthwith difcharged and fet at Liberty, in the Prefence of fuch Juftic^ or Chief Magiftrate; but if fuch Perfon or Perfons ftiall refufe or negledt, within the Space of twenty-four Hours to return and pay fuch Money a? aforefaid, he or they ftiall be deemed and taken to be inlifted, as if he or they had given his or their Afl^nt thereto before the faid Juftice or Chief Magiftrate; or if fuch Perfon or Perfons ftiall declare his or their having voluntarily inlifted himfelf or themfelves, then fuch Juftice or Chief Magiftrate ftiall, and he is hereby required forthwith to certify under his Hand, that fuch Perfon or Peribns is or are duly inlifted; fetting forth the Place of the Birth, Age and Calling of him or them refpedVively (if known) and that the fecond and third Sections of the Articles of War for the better Government of his Majefty's Marine Forces while on Shore in Great Britain or Ireland, were read to him or them, and that he or they had taken the Oath of Fidelity mentioned in the twelfth Se6tion of the faid Articles of War; and if any fuch Perfon or Perfons fo to be certified as duly inlifted, fhall refufe to take the faid Oath of Fidelity be- fore the faid Juftice or Chief Magiftrate, it fhall and may be lawful for fuch Officer, from whom he has received fuch Money as aforefaid, to detain or confine fuch Perfon or Perfons until he or they fliail take the Oath before required; and every Officer of Marines that fhall a6l contrary hereto, or offend herein, 'upon Proof thereof upon Oath made by two Witnefl"es, before a General Court-martial to be thereupon called, fhall for fuch Offence be forthwith caftiiered and difplaced from fuch his Office, and ftiall be thereby utterly difabled to have or hold any Civil or Military Office or Employment within this Kingdom, or in his Majefty's Service.
