' "^ 7 H E R E A S by an A(£l made in the tyrenty-fecond Year of his Majefly's Reign, intituled, An Act ThU Aa Win ' W for making a free Market for the Sale of FiJh in the City of Ye9t.n-i ^}.cr ; and for preventing the fore- Fart repealed by < falling and monopolizing of Fiji} ; and for allowing the Sale of Fiji) under the Dimenfiens mentioned in a Claufe 33 Geo. 2. c. 27. i. contained in an AS of tloe firjl Year of his late Majefys Reign, in cafe the fame are t ken vuith a Hook ; it is
- amongft other Things therein enafted. That if any Fiflierman or other Perfon cr Perfons whatfoever, Na-
- tives or Foreigners, fhould keep any Fifh at ^tecnborough, Gravefcnd, or other PLxe or Places, in any
- Well- boat. Store-boat, or any other Manner whatfoever, fo as not to fell oft' their whole Cargo of Fifh
' within the Space of eight Days from their Arrival on the Britijl] Coafl, between North Yarmouth and Do- ' ver, after their firfl Arrival at the refpeftive Place or Places as aforefaid, every Perfon or Perfons fo of- ' fending, and being thereof lawfully conviiEled by the Confeffion of the Party, or the Oath of one or more ' credible Witnefs or Witnefles, fliould for every fuch OfFence forfeit the whole Cargo of Fifh belonging to ' him, and alfo the VefTel, with her Tackle, Apparel and Furniture, to be levied by Diftrefs and Sale by " Warrant under the Hand and Seal of any one or more of his Majefty's Juftices of the Peace for the re-
- • fpeftive County where the Offence fliould be committed ; which Warrant or Warrants the faid Juftice or
' Juftices was and were thereby impowcred and required to make, upon the Information on Oath of one or
- more credible Witnefs or Witnefles (which Oath the faid Juftice or Juftices was and were thereby impow-
' ered and required to adminifter) and that the Produce thereof fliould go and be applied, one Moiety to the ' Ufe and Benefit of the Informer or Informers, and the other Moiety to the Poor of the Parifli where the ' OfFence fhould be commi;ted : And whereas many Difficulties have arofe in putting the faid Act in Exe- ' cution, which have hitherto not only obftructed the Eftablifliment of the faid free Market at JVeJhninfier^ ' but hath rendered ineffectual the other good Purpofes of the faid Act, and more particularly the preventing
- the foreftalling and monopolizing of Fifh in general : And whereas the faid limited Time of eight Days for
' felling ofF the whole Cargo of Fifh, as in the faid Act mentioned, is found too fliort, in Confideration of ' the great Diftance between iVar/Zi Yarmouth and Dover, and the faid Towns of ^I'.eenborough and Gravefend, ' where the faid Store-boats and Well-boats do ufually lie to receive the Fifli from the fifhing Ships, as it ' may often happen, that from the common Accidents of Wind and Weather fo much of the faid T"ime may ' be ipent from the Time of their firft Arrival, before the faid Veflels can afterwards arrive at the laid Pla-
- ces for unloading their faid Cargoes into the faid Store-boats or Well-boats, and for Sale thereof, that the
' faid Fifliermen may unavoidably incur the Penalty in the faid Act mentioned for not felling off their whole ' Cargoes within that Time, and for that the Fifhermen and others employed in the Lobfter Fifhing or Lob- ' fter Trade, do require an Enlargement of the Time for felling off" their Cargoes, after their Arrival in the ' faid River of Thames, the faid limited Time of eight Days not being fu;lii.ient for that Purpofe : And.
- whereas, for the rendering more effectual the good Ends and Purpofes of the faid Act, it is necefFary that
' a proper Officer be appointed to infpect and fearch the iaid fifhing Vefi'els, and the faid Store-boats and
- Well-boats, for the better Difcovery of fuch Perfons who fliall make Default in felling off" their Cargoes
- within the Times limited for that Purpofe, as it may be alfo very ditncult, from the great Extent of the
' faid Limits appointed for the firft Arrival between North Yarmouth and Dover, to afcertain fuch Arrival, fo ' as duly to bring the Oifenders therein to Juftice, without a continual Infpection : And whereas it is alfo ' neceflary for the Purpofes aforefaid to impower the fcveral Mayors of J^ueenborough and Gravefend, and any ' other Perfons acting as Juftices, who are Members of the faid Corporations, and any other his Majefty's ' Juftices of the Peace between the faid Towns and the Cities of London and IVeflminfter, to act as Juitices ' in levying the Penalties in the faid Act, as well as fuch Juftices of the Peace for the refpective County ' where the Offence is committed : And whereas by the faid recited Act it is enacted. That the feveral Kind's ' of Fifh thcrcin^^particularly named and mentioned, may be expofed to Sale, or exchanged for other Goods, ' provided fuch Fifh are taken with a Hook, and fo not fit or capable of being preferved alive, although the J Geo. I. c, 18. ' faid Fifh Ihould be under the Dimcnfions prefcri'bed by an Act pafled in the Reign of his late Alajefty, ' intituled. An ASlfor the heitcr preventing frejl) Fiflj taken by Foreigners being imported into this Kingdom ; and, ' for the Prcfervation of the Fry of Fijli ; and for the giving Leave to import Lobjlcrs andTurbet in foreign Boi- ' toms ; and for the better preferving of^ Salmon ivithin fvcral Rivers in that Part of this Kingdom called Eng- ' land ; in the faidrecited Act mentioned ; which Liberty w.as fo allowed, that the Market might be the ' more plentifully fupplied M'ith fuch Sorts of Fifh, and that the Publick might be ferved therewith at more
- reafonable Rates : And whereas fuch Liberty hath not been attended with fuch good Eft'ects as was ex-
' pected.
