He was 2d a. of Alexander, 2d Eaul of Linlithgow [S.] being his 1st, g. by his 2d wife Mary, da. of William (Douglas), Haul of Angus [S.] On 21 May 1657, he appears to have been iufeft, subject to his Unele's life rent therein, "of the whole lands of Calender, with the title and honour of Earl of Calender and h>rd Alniantl," and again on 7 May I960, a few months before the patent of 21 Nov. 1660 which entailed the same on him. He in. (contract dat. lGti-'i), Mary, 3d da. of William (Hamilton), 2d Duke of Hamilton [S.], by Elizabeth, da. of James (Maxwell), Haul ok Diulkton [S.] Ho d. s.p. legit.(") Aug. 1685. His widow m. Sir James Livingston, of Westipiarter. She mi. thirdly (as his 2d wife) James (Ogilvy) 3d Eaul op Findlatkii [S.] who d. 1711. III. 1GS5. 3. Alexander (Livingston), Earl of Calendar, &c. [8.1 nephew, by the br. and h. according to the designation in the patent of 1660, being 2nd son of George, 3rd Eaul of Linlithgow [S.j, by Elisabeth dau. of Patrick (M.U'LK), Haul of Panmuki: [S]. He on 1G May 1CSS was served h. of IHttail to his Dhole. He m. Anne, 1st da. of James (Guah.ym), 2nd M.viiqUEss of Montiiose [S ], by Isabel, da. of William (Douglas), Eaul of Mouton [S.] He d. Dec. 1692. IV. 1G02, J f . James (Livinoston), Earl of Calendar, .vc. [S.J, to only s. and h., served h. to his Father 1 Aug. 16*8. On 7 Aug. 167S 1715. he sue. his uncle as E.UM. of Linlithgow, &e. Viscountcy jf. "George Feilding, s. of William, Eaul of Den- high, anil nephew of George, [afterwards Date, but then] Maiujukss of Buckingham, High Admiral of England," was, on 7 Nov. 1622 I. 1(122. cr. BARON FEILDING OF LECAGH, co. Tipperary, and VISCOUNT CALLAN, co. Kilkenny |L] with a grant of the reversion^) of the EARLDOM OF DESMOND, co." Kerry [I.] on the death of ( il ) Sir Alexander Livingston, of Glentirran, was a bastard sou of the 2nd Earl. ( b ) On his death the issue male of all the persons named in the patent of lfiu'0 became extinct.* " If, however, the letters patent did not proceed upon a resignation, as appears to have been the case, they could not affect any honours which could be claimed under the previous grants," i.e. the Barony of 1633 granted to heirs nude, and, (if the deed could be proved), the nomination (7 May 16U0) of the final rem. of the Earldom, &c, in favour of nearest heirs male. In 1784 Sir Alexander Livingston, Bart., received from the Attorney Gen. (afterwards Lord Kenyon) a favourable opinion as to his claim, as h. male ycncral, to this Earldom. In June 1S21, his s. and h, Sir Thomas L., Bart., presented a petition to the King to the same effect (Lords Journals, V. 54, p. 504). He d. s.p. 1 April 1853. when the issue of William, 6th Lord Livingston [S.], who d. 1592, appears to have become extinct, that of the 5th Lord remaining. See " Hewlett," pp. 124-128. (°) This reversion was in contemplation of his marriage with Elizabeth, only da. and h. presumptive of Richard (Preston) Eaul of Desmond and Baron Dumnore [I.] and Lord Dingwall [S.] whose Irish Peerages, cr. 11 July 1619, would on his death s.p.m. (which occurred 2S Oct. 1628) become citinet. The match, however, never took place, as in 1629 the said lady in. James Butler, then styled Viscount Thurles, afterwards the celebrated Duke of Ormonde. "This [latent refers to a patent dat. at Westui. 11 July [1619] 17 Jac. I, by whieh Richard Preston, Knt , Baron Preston of Donmore, was cr. Earl of Desmond. No entry of it has been found in the Calender to the English Patent Rolls of that date," where this patent [7 Nov. 1622] is enroUed.
