Robert Fitz- Walter, s. and h, of Sir Walter Fitz-Simon, who was s. and b. of Simon Fitz-Walter, next yr. br. to the celebrated Robert Fitz- Walter (" Marshal of the army " of the Barons who obtained Magna Oharia) was by Writ 26 Jan. (1296/7), 25 Ed. I., addressed " Hob.' fil' Walteri dc Baventrc," sum. to attend the King at Salisbury, but such writ did not constitute a regular summons to Parl.( a ) which was never issued to him or his descendants. i.e., " Fitz Walter," Viscounty (Raddiff), er. 1525 ; see " Sussex " Earldom, a: 1529 ; both titles becoming extinct in 1643. ' same, by his first wife, Eleanor, da. and eventually coheir of John ■t a ~- Foote, of London, Banker, was b. 2 June 1801. at Goodneston Park «>'»■ al'sl. ; ed. at Winchester School and at Oriel Coll., Oxford; B.A., 1S22 ; M.A., 1S27; was II. P. for East Kent, Feb. to July 1852 and IS57-6S. He claimed in 1841 the Barony of Fits-Walter (er, 1295) and proved himself heir to a moiety and probably to the entirety thereof.( b ) The abeyance of this Barony was, however, not terminated in his favour, but he was, some quarter of a century afterwards, cv. 17 April 1868, BARON FITZ- WALTER OF WOODHAM WALTER, co. Essex. He m. 4 July 1831, his cousin, Fanny, 1st da. of Lewis Cage, of Milgate. in Bersted, co. Kent, by Fanny, sister of Sir Brook William Bridges abovenamcd, and 1st da, of Sir Brook BRIDGES, 3d Bai t. She d. 28 Oct. 1874, aged 81, at GoodneBton Park. He d. there s.p. 6 Dec. 1875, aged 74, when the peerage became extinct. FITZ-WARLNE. Barony by 1. Fulke Fitz-Warine, of Whittington and Alberbury, Writ ca Salop, s. and h. of Fulke F. of the same, by Clarice, his wife, sue. his father (who was slain, ex. parte Regis, in the battle of Lewes), 14 I. 1295. May 1264 ; made proof of his age (1273), 1 Ed. I., and having served in the Welsh wars was sum. to Pari, as a Baron [LORD FITZ- WARINE], from 23 June (1295), 23 Ed. I. to 24 Oct. (1314), 8 Ed. II., the last two wards Aug. 1765] died without issue and thus the Barony is now [1844], in abeyance between the petitioner (as grandson and heir of Dame Fanny Bridges), and the descendants (if any) of Jemima Duke." It is to be noted that the words "if any " (which form part of the resolution), imply doubt as to existence of such descendants, and that if such doubt was but a certainty, the claimant (according to the modern usage), would be entitled to the Barony. A very different treatment was shewn to this {Conservative) claimant of a peerage to what had been, a few years previously, shewn to the {Liberal) claimants of the Baronies of Vaux, Camoys, Braye, Beaumont, Hastings and Co., peerages which (mostly) had for very many centuries been unheard of, and of which the fortunate claimants represented (mostly) a very Bmall fraction, while in this caso the Barony had continued uninterruptedly from 1295 to 1755, and the claimant represented an undoubted moiety, if indeed not the entirety thereof.
