Having been knighted, 30 Mar. 1566/7, at Limerick by the Lord Deputy, as James fitz Richard Barry, Viscount Buttevant, on 5 Apr. 1567 he had a Commission to execute martial law as " Sir James Barry knt, Lord Barrye more, Viscount Bowtyvant, " while 12 Mar. 1567/8, he received a Crown lease of lands, co. [I.], who, being 2nd s. of James, the 4th Viscount, entered into possession of the estate and assumed the title. He was of Barry Court, co. Cork. He was sum. to Pari. [I.], and appears in the list of Peers present, 26 Apr. 1585, as the " Viscount of Barry, alias Buttevant ; " and, in the Par), of 1613, was placed as "Viscount Barry 0/ Buttevant," next to the Earls. (") He joined Desmond's rebellion, and is said (in a letter of Queen Elizabeth, dat. 8 Aug. 1593) to have done so as "Viscount Barry," but abandoned the rebel cause in or before 1599, and as "Viscount Butte- vant" (which designation ('") henceforth became the usual one) was pardoned 15 Nov. 1602, and is frequently so styled in inquisitions, ^c. In 1601 he had a warrant " to levy all the risings out of the country, " and in 1602 commanded 1,600 men. On 20 May 161 5 he was one of the Council for the province of Munster. He m., istly, Ellen, da. of David (Roche), Viscount Roche of Fermoy [I.], by Ellen, da. of James (Butler), Lord Dunboyne [I.]. She was living as his wife, Oct. 1593, and apparently in 1 599. He m., 2ndly, Julia, 2nd da. of Cormac MacCarthy, of Muskerry. He d. (in the lifetime of his elder br., the de jure Viscount) 10 Apr. 1617, at Barry's Court. His widow m. Sir Roger O'Shaughessy.
