XXIV. of October. ij8i. 231 QUHAIRFOIR, OUR SOVERAINE L O R D , with advife of his three Eftaites in this pre- fent Parliament , Ordainis, That all Letters of Law-borrowes , fall be direct in time cumming , at the in- ftance of the pairties compleenand , Chairgeing the perfones compleened upon , to finde flcker fovertie and Law-borrowes, that the compleeners , their wives, bairnes, tennentes and fervandcs , fall be harmeles * and skaithles in their bodies , Landes , Takkes , poflefllones , guddes and geare , and on na waves to be molefted or troubled theirin , be the perfones compleened upon , noma udiers of their caufmg, fending, hounding-out , receipting, command, afliftance and rati-habition , quhome they may ftoppe or letdirect- lie or indirectlie, utherwayesnorbeordourofLawandJuftice, under great paines to be modified be the Lordes of Seffion , or uthers ordinar Judges , Be quhome, in cafe the faid Law-borrowes fall be dewlie rryed to be broken , the ane halfe of the paine fall perteine to OUR SOVERAINE LORD, and theutherhalfetothe pairtie grieved, according to the effect and meaning of the faid Act, maid to that effect of befoir. 118. Anent deforcements , breaking of Arreiftmentes , and Alienat tones maid in de- fraud of Creditoures. FORSAMEIKLE, As it is heavelie compleened to OUR SOVERAINE LORD, be divers] his fubjectes : That quhen they have upon their lang travell and expenfes recovered their fentence , they ar deforced in execution thereof. Lyke as quhen Arreiftmentes ar maid to make the gudes furthcum- mand, after die recovery of the debt , the famin ar contempnandlie broken. Andfarder, the execution offentences and decreetes are oft-times impedite be fraudfull alienationes of the debtoures Landes and gud- des , maid be them throw colorate meanes , to their friendes and conjunct perfones. And the Pleyes and aftions upon deforcements, breaking of arrestments, and reduction of fraudefull alienationes , hes bene fwa tedious, fumpteous and langfum , that very lewe of them are brocht to ony gude end, quhairby out Soveraine Lordis Authorise is contemned , and his Subject es are brocht to great inconvenient. For remeid quhairof , IT IS itatute and ordained , That the Lordes of Councell and Sefllon proceede fummarlie and diligentlieinallactionesofdetorcemenr.es, and breaking ol arreiftmentes , to be intented before them , at the inftance of quhatfumever perfones , and fpeciallie that the faidis actiones , quhen they are called, fall with all convenient fpeed without intermifTion be put to ane poynt , after the calling thereof. And that the perfones convict of deforcement , or breaking of arreiftment, fall be punifchedbe the Efcheit of their guddes movabill, andpunifchmentof their perfones, at our faid Jbveraine Lordis will , according to the Lawes obferved of before, with this addition : That the pairtie recoverer of the fentence, fall be firft payed of his debt and of his expenfes , to be heichlie taxed be the faidis Lordis , and of ane certaine fumme of money to be modified at the faidis Lordis difcretion, to the pairtie, for the damnage and inte- reft fufteined be them. Anent the quhilk the pairtie intereft, fail have the reddie execution upon the flrft and reddieft guddes and geare of the perfone convict : Notwithftanding the richt of the Efcheit perteining to O U R faid SOVERAINE LORD, quha for weill of his fubjects , will and grantis , that the creditours be preferred to him in this cafe. And further with advife of his faidis three Eftaites , I T I S ftatute and ordained be his Hienes : That all giftes of efcheit, quhilkis fall be given hereafter , to quhatfum- ever perfon or perfones of guddes, geare,and uthers cummand in his Hienes handes for deforcement,or break- ing of arreiftment, fall conteine exprefle exception and refervation , to the Creditour , of the fummes reco- vered for his principall debt , expenfes and fumme, to be modified as faid is. And gif ony gift of Efcheit pro- ceeding upon the caufe forefaid , be given without the faid refervation and exception , the lame fall be null & of nane availl. And fik-like, for the greater expedition of reduction of Alienationes and difpofitiones of Landes and guddes, maid in fraude of the Creditour , IT IS ftatute and ordained, that the famin be maift farnmarlie decided and priviledged be fum mondes upou ^ 1 • dayes warning , without diet , table or con- tinuation of uther fummonds. And that the Pairtie receiver of the faidis fraudefull alienationes and difpofi- ones, fall not be heard to defend therein, except that they (before they be admitted to produce the faidis aliena. ones and difpofitiones , and to anfwer to the fummonds ) configne in the handes of the Clerk of Regifter and his Deputes, for quhome he fall be halden to anfwer, fik fummes of money, as fall be modified, be the difcretion of the faidis Lordes, to be delivered to the pairty perfewer , in cafe the faidis alienationes and dif- pofitiones fall be declared fraudfull. 119. Anent regiftration of " inhibit iones and interdiBiones. ITEM, Albeit interdictiones and irihibitiones , for many great and weichtie confiderationes , to di- vers intentiones , ar very neceflar and profitable : Neverthelefle , it is of lait confidered , that die faidis inhibitiones and interdi&iones , ar greatly abufed , to the hurt and prejudice of our Soveraine Lordis lie- ges, contrarie to the end quhair-unto they were flrft directed : In fa far, as interdictiones , for the maift pairt proceedis upon confent of pairty , like as the faidis interdictiones , and letters of inhibition , oft-tentimes proceedis uponlicht caufes : The executiones quhairof, arfundrie times forged and fenzeit , and after mony zeires , the executor and witncfles being deceafled , the faidis inhibitions and interdictiones ar ufed againft our Soveraine Lordis lieges , at the inftance of the receivers thereof, and uthers , for refcinding & retreating Liz of
