And or- dainis this to have execution againft all perfons , exerceand the trafficque of Merchandife , or uther change , in onie of the Burrowes of this Realme, whidder they be admitted Free-burgefles therein, or not : Provi- ding alwayes that it fail be leafurri to his Hienes , notwithftanding of the faid Act , to exeeme from the faides taxations, watching and warding , ane perfon of ilk craft , for his Hienes particular ufe and fervice, in cafe his Majeftie finde it gude and expedient to be done. Andfik-like, that this Acl be not prejudiciall to the members of die Colledge of Juibce , and to their priviledges and immunities granted unto them , or whereof tbey have bene in ufe in times by-gane. 154. Exercife ofcraftes , within fub-urbs adjacent to Burr owes , is forbidden. ITEM, For-fa-meikle as the exercife of crafcef-men, inthefub-urbesofthefree-Burrowes, is not onlie hurtfull to all our Soveraine Lords lieges for the in-fufficiencie of the wark : bot alfo miniftratis great occa- fion to Prentifes and fervands in free- Burrowes, un-dewtifullie to leave their Maifters , and to remaine and abide in the faides fub-urbes , thereby fubftra&ing themfelves , fra the jurifdiftion of the Proved and Baillies of the faides Burrowes. Andalsthe free craftef-men, refident within the faidis Burrowes, are greatlie damnified , feeing they beare ane great part of the charges of the Burgh , and the advantage of the wark , that fold relieve them is drawen away to the faidis fub-urbes : Therefore our Soveraine Lord , and haill Eftaites of this prefent Parliament , ftatutis, declaris and decernis that in all time cumming , there fall be na exercife ofcraftes in the fub-urbes adjacent to the faidis Burrowes : Bot that the famin fall ceafein all times here- after; And that it fall be leafum to the Proved and Baillies of the faidis Burrowes , and their deputes and flfficiares, to intromet with all the warkes that fall be found wroucht, or in working: quhidder the matenal- les thereof apperteine to the craftef-man himfelie , or to quhat-fumever perfon , and to efcheit the famin , to be applyed to the commoun warkes of the Burgh nixt adjacent to the faids fub-urbes. 1 5 5 • *s4gainft granting of re/pettes and remijfiones. FO R Furthering of the punifhment of flauchters , fire-raifinges , and utheris odious crimes , committed in diverfe partes of the Realme , thir findrie zeares by-gane , upon fet purpofe and fore-thought fellonie, totheoftenfeofGod, and contempt of our Soveraine Lordis authoritie : His Hienefle followand the lova- ble exemple of his maift Noble Progenitoures , in like cafes , of his fpeciall favour , and at the inftant requefl of his Eftaites , at this prefent Parliament grantis , and in the word ot a Prince, faithfullie promittis , that he fall clofe his handes , and ceafe fra granting onie refpites , or rernifliones , for ony maner of flauchter , fire- raifing, or uther odious crimes , thai fall be committed , upon auld feed , and fore-thoght fellonie , for the fpaceof ^.zeiresnixt-to-cum, afterthedait hereof: that in the meane time, the Realme may be put in peace, and his Lieges maid to live in fovertie, except the faid refpit or remiftion fall be craved to the offen- der, be the wife, bairnes or neareft iriende , of die perfon that hes received the ofFenfe : Orthatafufficient letter of flaines, feene and perfitelie confidered be his Hienes Councell; And gif ony refpite or rernifli- ones fall happen to be granted for auld actions , that it be expreemed in the fame, that the trefpas was com- mitted, before this^refent Parliament; And that his Hienefle and his Councell, hes feene quhair the par- tie is aflythed: utherwayes declaris the fame refpite or remiffion , to be null, and of nane availl. And in- cafe ony fik rernifliones or refpittes (as God forbid) fall happen to be granted and paft : Ordainis and com- mandis his Hienefle Juftice , Juftice-Clerke , and their deputes , to proceed and do Juftice upon the per- fones ufers thereof : Notwithftanding the faidis remiflions and refpittes, as git the famin had never bene (granted or produced : And ordainis all perfones , that hes alreadie obteined refpittes, for the faidis crimes, fen his Hienefle accepted the governement of the Realme in his awin perfon , to be called to underlythe Law for the fame : At the inftance of die partie offended , gif they pleafe to perfew.
