XIX. of December. i 597 . 361 AND Furder, I: is ftatute and ordained , that all the Stewardes and Baillies of onie part of his Hienes the Kin ■ propertie , fall with all convenient expedition , caufe retour the haill landes of the famin , everie ane withi n pl^rtif" li^ awin boundes and jurifdidion, and that to the famin availe, quantitie and proportion, as onie uther landes lyand nixt adjacent to the fame, halden of his Majeftie , ar fet or retoured to : having neverthelefTe anc ipeciali regard to the free-rent , that the fewars and rentallers hes of the fame lands , befide their few-fermes and dewties payed be them, to our Soveraine Lord : Quhilks landes being retoured , asfaidis : It is or- dained that letters be dired be the faid Collector of this prefent taxation, charging the faidis Stewardes and Baillies , to raife and up-lift die fumme of fourtie lhillinges of everie pound lande , that his faid Hienefie pro- pertie fall be retoured to, everie ane within his awin jurifdidion , and in-bring and deliver the fame to the laid Colledour , betuixt and the faid fifteenth day oiCMarch nixt-to-cum , under the paine of rebellion, &c. And becaufe his Majefties propertie hereof, hes navvayes bene in ufe and confuetude of payment of ony part of ony taxations granted heretofore , nether did they relieve the refte of the Lieges, of ony parte of the famin. His Hienefle and Eftaites forefaidis , thinkis it maift meete and expedient, that the faid taxation to be up-lifted fra the faidis fewers, tennentes and tackef-men, of his Hienefle propertie , fall be na-wayes accompted nor allowed in part of the faid fumme of twa hundreth thou- iandmarkes; bot the famin fumme to be up-lifted , according to the divifion abone written : Andthefum- mes to be up-lifted of the landes of his Hienefle propertie , to be maid compt of be the faid Colledour , over and befide the fumme of twa hundreth thoufand markes , granted, asfaidis : Providing alwayes that the famin be na-wayes employed nor beftowed to ony ufe quhat-fum-ever , except to the famin erred that the uther great fumme abone written. And for their reliefe : That letters be direct , chargeing all and findrie i nhabitantes of ilk Burgh , to conveene and eledcertaine perfones, to ftent their nichtboures : And the faid eledion being maid , to charge the perfones eled , to accept die charge upon them , in fetting of the faide ftent upon the inhabitan- tes oi ilk Burgh : And to convcene and fet the famin, and make ane ftent roll there-upon , as effeiris, within twentie four houres, nixt after they bee charged thereto , under the payne of rebellion &c. IT IS ALWAIES Provided, that na perfon quhat-fum-ever be ftented or taxt within Burgh ,- except according to the availe and quantitie of his rente, living , guddes , and geare that he lies widiin Burgh, nawayes refpedand his landes and pofleffiones, quhilkis he lies to Landwart , tor the quhilkis hee will be oblilhed to pay taxation to uthers ofEciers. Quhairas of reafon , the faidis tennentes , fuldbe kktogidder free from the payment of onie taxation : And the famin fuld be payed be fik as lies free-rent, lan- Pes , and guddes of their awin : For remeid quhairof , It is ftatute and ordained , that na perfon quhat-fum- bver , exact or compell his tennentes and Fermorers removeable , quha payis him fexme for the landes occu- py ed be them, to pay ony parte of this prefent taxation, or to fute reliefe for die famin, at their handes.
