In that cafe they may lawfullie refufe any fik perfon prefented un- to them. Bot if the partie who is prefented hath referved to himfelf and his Succefibrs a fufficient maintenance, the fetting of tacks or promife to doe the fame or doing of any thing els to his Patron (being nor prejudicial to that aforefaid maintenance) fliall no wayes be afcry ved to any Simoniacall paction , nor fliall not ferve for any reafon to the Archbifhop or Bifhop to refufe him. And incafe any fik contraverfie or queftion ihall occurre betwix the Patron , the perfon prefented and the Arch-bifhop or Bifhop. I T is declared , that the Lords of Counfell and Seffion fliall be Judges thereunto , to decyde upon the laid Simoniacal padic n and qualitie of the fame , if any fik thing ihall be objected againft the partie prefented. IN DEPOSITION of the Minifters , the Bifhop afiociating to himfelfe the Miniftrie of thefe boun- des where the delinquent ferved , he is there to take tryell of the fad , and upon juft caufe found to depryve : And the lyk ordour to be obferved in fufpenfion of Minifters irom the exercife of the function. THAT E V E R I E MINISTER in his admiffion ihall fwear obedience to his Majeftie , and to his Ordinar , according to this forme following, I k^A, B. now nominat and admitted to the Kirk of®. Teftifie & declare in my conference, Thatthe RIGHT EXCELLENT, RIGHT HIGH, and MICH- TIE PRINCE, JAMES the Sext by the grace of G O D , King of Scotland , England , France , and Ireland: defenderof the Faith ,&c. is the only lawfull Supreme Governour of this Realme, Alfweelin matters Spiriaial and Ecclefiaftical , As in things Temporal : And that no foreine Prince, State nor Potentat, lies or ought to have any jurifdidion, power, fuperioritie , pre-eminence , or authoritie, Ecclefiaftical or Spiri- tual, within this Realme. And theirfor I utterlie renunce and forefaike all foreine jurifdidion, power, fupenori- ties & authorities. And promefs that from this iurth I ihall and will bear faith, and true alledgence to his High- nes, his heires and lawful! fuccefibrs : And to my power fall affift and defend alljurifdictions, priviledges , pre- eminences, and authorities granted and belonging to his Highnes, his heires,and lawfull Succefibrs. Or united and annexed to his Royal Crown. And forder I acknawledge and confeffe to have and to hold the faid C and poffeffionofthe fame under GOD, of his Majeftie , and his CrowneRoyall of this Realme: and for the faids pofieffions , I doe Homage prefentlie to his Highnes in your prefence , and to his Majeftie his heires and lawfull SuccefTors fliall be true. THAT THE VISITATION of ilk Diode be doone be the Bifliop himfelf and if the bounds be greater then he can overtak. That then hee make fpeciall choife of feme worthy man of the Miniftrie with- in the Diocie , to vifit in his place : And what ever Minifter without juft caufe or lawfull excufe made fall abfent himfelfe from the vifitation or the Diocefian affemblie , He ihall be fufpended from his office and bene- f fice: and if he amend not, he fliall be depry ved. THAT THE CONVENTIONS Of Minifters for exercife , fliall be moderated by the Bifliop being prefent , and in his abfence , by any uther Minifter whome he fliall appoynt at the Synode. WhilksAds, Ordinances, declarations, and determinations above written , his Majeftie finding to be verie agreabie to the true Religion profeffed within this Kingdome , and to the godlie and decent governement j of the Kirk , Miniftrie , and whole members thereof. Therefore , his Highnes with advyfe and confent of the Eftaites of Parliament, Ratefies, approwes , and confirms all and fundrie the premifles, andOrdeinsj them and everie ane of them, to be obeyed and obferved , be all his Highnes fubjeds as inviolable Lawes in all ty me comming.
