Anent the Election of Arch-hifhops and Bifhops. ^S°5^^||Jof U R ' ■ S O V E R A I G N E L O R D , with advife and confent of the Eftates of this ^Wn^TD^Itl&'P P re ^ ent Parliament, for gude and folide Ordour to be keiped in all time to come, For j^ip^^fefp election of Archbiihops & Bifliops-.Statuts & Ordains.that all who ihall be hereafter ^f^Pi^^^^wl?-; P rorn °ved to any Archbiilioprik or Bilhoprik within this Realmefliall be elected 1 t~ 1 1 I and admitted according to the forme and maner under mentioned and no utherwife That is to fay, when it mall fall any of the Seas to be made void ; His Majefties pkafure is to grant licence to the Deane and Chapter of the Cathedral Kirk of the W Sea , to convene themfelfes for electing of ane uther Archbifhop or Bifliop in place 1 ^^^j-BM^M^^^^ cf the former incumbent. And the laid licence being exped, ane Edict ihall be affixed upon the mod patent dure of the Cathedral Kirk , requiring and charging the Deane and Chapter of the faid Kirk , to conveine themfelfes for chufing of ane Biiliop to the fame , who Ihall be devote to GOD, and to his Highnes and Realme profitable and faithful. Who being conveined the Deane of the faid Chapter with fo many of them as mail happen to bee afiembled, mall proceed and chufe the perfon whome his Majefty pleafed to nominat and recomend to their Election , Hee alwayes being ane actual Minifler of the Kirk , and mail Elect none uther then ane actual Minuter] : to be fo nominat and re- comendit be his Majeftie as faid is. After the which Election teftifled under their Seals and fubferiptions , , His Majefties pleafure is to give his Royall aflent thereto : And the fame aflent being granted under his Ma- jefties great .Seal , mall be to the perfon elected ane fufticient right for injoyiag the fpiritualitie of the Bene- fice whereunto hee is elected during his life-tyme . Upon the which aflent , and his Highnes mandat to be : directed to ane competent number of Biihops within the Province where the Benefice lyes , The perfon elected ihall be Confecrat and received in his function bee the rites and ordor accouftumed. And the faid confecratioa being made his Majefties pleafure is to difpone to the perfon elected the temporalitie of the faid Benefice with all Priviledges, honours , and dignities , belonging thereto. And the fame grant being pad: under his Majefties great Seal ; Then ihall me perfon admitted doe homage and fweare obedience to Our 1 Soveraigne LORD, according to the forme prefenbit. Neither Ihall it be lawfull to the perfon admitted to intromet with any of the fruites ane! rents of the faid Beneflce,untill he have performed the laid homage and given the Oath of allegeance and fidelitie to his Majeftie or his Highnes Commiiiioners to be appoynted for that effect. And for the better observing of the faid ordor in all tyme hereafter, OUR SOVERAIGNE LORD, and three Eftates Inhibits and difcharges the Lords of Counfel an Seffion to authorize be their Decreit and fentence the provifion of any Bifliop to be admitted hereafter , except that it be teftified that he is received and entered according to the laid order in all points. ACT II. Anent the Ikeftitution of Chapters. . U R SOVERAIGNE L O R D , with advife and confent of the Eftates of this prefent Parliament, ' Con fidering hew neceflar it is that the Deane, and members of Chapter of everie Cathedral Kirk, be at all occafions readie to conveene themfelfes for die election of Arch-Bifhops and Biihops , to their feveral Seas, and for expeding of particular rights made to the Leiges, whereunto their confent by the Lawes of the Realme is required, and that for fupporting of the charges of their fervice. and inabling them the better to attend at fick occafions , It ismoftneidfulitheybereftoredtotheirMahfes, Gleibes, rents and livings be- longing unto them of auld. HAVE Statut and Ordained , that all the Deanes , and uthers members of the Chapters of the Ca- thedral Kirks within this Kingdome , fhall be reftored to their Manfes , Gleibes , Rents , and uther patri- monie belonging to them.
