Whom, or any eight of them, his Majefty , with advife forefaid , ordaines to meet and conveen together , at fuch time and place as they mail think expedient , and to confult and advife together, and to appoint and determine upon the mod convenient means , how the faids meafures and weights may be reduced to the con- formity aforefaid. A nd after they have ripely advifed therewith , and given forth their determination thefe- anent , they lhail deliver the fame , and whole courfe of their proceedings, to the Conimiffioners and Juftices of Peace , and to the Deanes of Guylde of the head Burghs of the Shires , who mall be holden carefully to do their diligence, to fee the meal ure forefaid now appointed , to have the courfe through all partes , as well Burgh as Landward. And that there may be one conftant conformity betwixt Burgh and Land , OUR Soveraigne LORD, with advife forefaid , Ordaines the faids Juftices of Peace in Landward , to take tryall of the meafures and weights ufed in Burgh , and to take NOTE from the Magiftrates and Deanes of Guyld of every Town ,' of the weights and meafures , and of the number thereof, which the faids Magiflrates and Deanes ofGuyld in Burgh, mall be holden to fhew , declare, and give up to them , to the efrecl the faids Juftices to Landward , may confer the fame with the Standard now authorized, and where they finde any difconformity in the fame, from the laid Standard , the faids Juftices mall inform the Kings Maje- fties Counfel thereof , that they may take order therewith as appertained!. For it is exprefly provided by thefe prefents , that the faids Magiflrates in Burgh fhall not be permitted to have or ufe anymoe meafures within their Townes , than the number to be prof efled by them , and given up in NOTE, to the faids Ju- ftices to Landward , as faid is. This alwayes being refpe&ed , that if the faids Magiftrats within Burgh finde any neceflity for having any moe meafures then was given up , and ufed by them before, I T mall be li- cenced to them to make moe meafures , they being anfwerable and conform to the Standard , and making the faids Juftices to Landward forefeen and acquainted therewith , and declaring the number of the meafures whereof they finde the neceflity of ufe. THE faids Juftices fhall be holden to give command and direction to their Conftables , to apprehend any fuch perfon who fhall be found contemptuoufly to have difobeyed the cenfures of the Church, they being law- fully required to doe the fame. XXIII. THE faids Juftices of Peace, alfwell to Burgh as Land , fhall conveene and be prefent at the Quarter- Sefllons of the Shire , where the Burgh and Land lyes , give their Oath to the Bench at their admiflion, make their record, and make payment of the fines inrromitted with by them as Juftices of Peace of that? Shire , and to their Collector. XXIV. THEY fhall appoint a fufficient Colledor for uplifting the fines and penalties which they have power to 1 impofe upon any offender , and are to take caution of him for making due accompt. XXV. THEY fhall have induring the time ofSeflions, for every day of their abode (fo it do not exceed the number of three dayes at the molt at one time ) allowed to every one of them fourty fliil- lings Scots money , daily to be payed and uplifted by the Collector of the fines, but neither Earle , Lord, Billiop, Privy - counfellour , orSeflioner, mail have any allowance: and all fuch Juftices as have the be-: nefitof that allowance , and fhall be abfent from every ordinary Quarrer-Seflions , or otherwayes when he is required lawfully by the Cufios RotuloYum , to any particular meeting , fhall incur the penaltie of fourty pounds, Scots money, not being lawfully excufed , and the excufe allowed by the reft of the Ju- | ftices there aflembled. XXVI. 1 H E Lords of Seffion fhall dirett general and fummaire charges of horning and poinding at the inftance of the Colle&or (appointed in every Country for ingathering of all fines and penalties whatfoever in- i curred) upon a fimple charge of fifteene dayes, and no fufpenfion fhall be granted , but upon confignation of ( the fummes contained in the fentence , and by finding caution for payment of the charges of the Juftices at the modification of the Lords. XXVII. THE faids Commiffioners at the end of every Quarter-Sefllon , fhall fend to his Majefties Councel a Catalogue of all fuch perfons as they have either committed , orotherwife put under furety , with a fhort abbreviate of the caufe thereof : to the effecT:, that thereupon the Counfel, as they fhall think expe- dient, may return to them againft their next Sefliqns, or to ttCuftos Rotukrum , in the meane while their further directions.
